ثمة أبعاد أساسية لمفهوم واحد، بل قضية واحدة شكلت المقاربات الإبستمولوجية والمنهجية المتعددة لها.
وفق ما يمكن أن نصطلح عليه بالمقاربات التضمينية. شكلت على الدوام الفهم الموضوعي والشامل لمجمل
قضايا حقوق الإنسان وبلورة فكرها الفلسفي والحقوقي والقانوني إلى نهايته أو إلى حدوده المطلقة. ونعني
بذلك، المقاربات النظرية التي تشكلت خارج القانون الدولي لحقوق الإنسان، إذ ليس أم ا ر نشا ا ز أن نجد هناك
تطارحا جدليا بين مفهومي البيئة والتنمية المستدامة في صلب النقاش الدائر حول المظاهر الجديدة،
والمجسدة لأزمة القانون الدولي العام في وضعه الانتقالي. ونظ ا ر للثغ ا رت التي تنتقص من طبيعة المفهومين
القانونية، فإن الباحث حاول إب ا رز أنهما أصبحا يشكلان ب ا رديغما قانونيا في مجال القانون الد ولي، بل قضية
واحدة لمفهوم واحد، وأبعاد متعددة. كما اهتم ببيان كيف اقتحم هذين المفهومين قارة حقوق الإنسان، بشكل
سلس دون إثارة تلك الحساسية التي تثيرها مواضيع أخرى كتلك المتعلقة بحقوق الإنسان نظ ا ر للخصوصية
التي تتميز بها المجتمعات.
ويقسم الباحث هذه الد ا رسة إلى مبحثين، يتناول في الأول إشكالية العلاقة الجدلية بين مفه ومي البيئة والتنمية
المستدامة. أما المبحث الثاني فيخصصه الباحث لق ا رءة تقييمية للواقع الدولي حول البيئة اولتنمية المستدامة.
وأنهى الباحث د ا رسته بخاتمة تضمنت نتائجا وتوصيات.
الملخص الانجليزي
There are fundamental dimensions to a single concept, and indeed one issue that has shaped the epistemological approaches and the multiple methodology of it. As close as possible. It has always formed an objective and comprehensive understanding of all human rights issues and has developed its philosophical, legal and legal thinking to its end or to its absolute limits.
In so doing, we mean the theoretical approaches that have been formed outside international human rights law. It is not uncommon to find that the concepts of environment and sustainable development are at the heart of the debate on new manifestations, which are embodied in the crisis of public international law in its transitional situation.
Given the lacunae that detract from the nature of the two legal concepts, the researcher attempted to highlight that they had become legal radicals in the field of international law, but rather a single issue of a single concept and multiple dimensions. I am also interested in showing how these two concepts have seamlessly penetrated the continent of human rights without raising the sensitivity of other subjects such as human rights because of the specificity of societies.
The researcher divides this study into two researchers, first dealing with the problem of the dialectical relationship between the concepts of environment and sustainable development. The second is devoted by the researcher to an assessment reading of international realities on environment and sustainable development.
The researcher concluded his study with conclusions and recommendations.
