لقد كان إسهام الحضارة الإسلامية في تطوير علم الرياضيات واضحا على يد الخوارزمي، وهذا نظرا لأهمية علم الميراث الذي يهتم بالحساب والكسور؛ كما مر تطوير طرق قسمة التركات عند العلماء بعدة محطات تم فيها اختصار وتبسيط طرق القسمة عدة مرات إلى غاية القرن (السابع عشر الميلادي ) ثم بقيت قسمة التركات على ما نراه اليوم دون استعمال المعادلات الحديثة بالرموز الرياضية. وهذا ما دفعني للبحث عن قانون رياضي من خلال المعادلة الرياضية لقسمة التركات بقواعد رياضية ألغي فيها ( التأصيل والتصحيح ) وذلك بالقسمة المباشرة للتركة أو باستعمال النسب المئوية بطريقة بسيطة تستخرج بأول نظر، وذلك في مسائل الميراث والوصايا المتفق عليها والمختلف فيها، فأقدم لكل نوع من مسائل الميراث قاعدة حسابية بسيطة تُمَكِّن أي شخص يتقن فقه الميراث من تقسيم التركة، فيتوافق ما درسه الطالب في سنوات الدراسة مع ما أقدِّمه من قواعد في هذه الأطروحة.
الملخص الانجليزي
Mathematics witnessed considerable development in the Civilisation including the contributions of Al-Khwarizmi. This is mainly for the importance of the fair distribution of hereditaments in Islam which is dependent on calculations and fractions. Moreover, the methods of inheritance distribution have been simplified through different stages till the 17th century. Later, the same methods remained in use till current times. This motivated me to search for mathematic equations to substitute the old methods likeTa`sil(finding the smallest number that we can subtract the number of heirs without using fractions)andTashih(finding the smallest number that can be divided by the number of heirs without using a fraction). The new equations should allow the calculations of hereditaments` distribution based on percentages. The calculations should consider both the agreed upon and the debatable Islamic laws of inheritanceand bequests. I shall provide a simple mathematic equation for each type of the cases of hereditaments` distributions, so that it can be consistent with what students have studied.
