تناولت هذه الدراسة التعاقد عبر الفيديو الذي يتم عن بعد بتلاقي الايجاب والقبول على شبكة اتصال دولية وبصورة تفاعلية مباشرة, وذلك من خلال وسيلة مسموعة ومرئية مما يجعل التساؤل يثور حول ماهيته ومدى جواز التعبير عن الإرادة باستخدام مخرجات الفيديو، وعن آلية ابرام هذا التعاقد، ومدى حجيته في اثبات التصرف؟ فقد هدفت هذه الدراسة إلى بيان النظام القانوني الذي يحكم هذا التعاقد من حيث الكيفية والحجية في الاثبات, كما أنها هدفت إلى إيجاد حلول تشريعية ولفت نظر المشرع والباحثين في هذا المجال, ولتحقيق هذه الأهداف اتبعنا المنهج الوصفي والتحليلي وذلك من خلال استقراء نصوص القانون وتحليلها, وبيان مدى قابلية القواعد العامة الواردة في هذه النصوص للتطبيق على هذا النوع من التعاقدات, وقد توصلت هذه الدراسة لعدة نتائج أهمها أن هذا التعاقد يتم ابرامه بشكل فوري ومعاصر بين الطرفين مما يجعل طبيعة التعاقد بينهما تعاقدًا بين حاضرين حكمًا شأنه في ذلك شأن التعاقد بالهاتف, كما أن له أثر في حياتنا اليوم؛ وذلك لأهمية الدور الذي يقوم به وازدياد التعامل به خصوصًا في ظل انتشار فايروس كورونا, وأنه وفي ظل غياب النصوص التشريعية التي تحكم هذه المخرجات, فقد تبين لنا أنه لابد من الاستعانة بالقواعد العامة إلى أن يصدر تشريع خاص, وهذا ما أوصينا به.

This study has considered contracting via the video which is performed remotely in which the acceptance is made over the Internet interactively and directly via using an audio and video means. This generates a question about its definition and the extent of permissibility of introducing the will via the video, the mechanism of performing the contact as well as its evidence in verifying the conduct?. This study has aimed to identify the lawful system that governs this contracting with regards to the mechanism and evidence of verification. It has also aimed to finding legislative solutions and drawing the attention of the legislators and researchers in this field. In order to fulfill these aims, the descriptive and analytical methodologies were followed via extrapolating and analyzing the texts of law and reflecting the applicability of applying these general rules contained in these texts on such a kind of contracts. The study has found several results, most important of which is that this contracting is performed immediately and fashionably between the two parties. This renders the nature of contracting between them is a contracting between attendees in principle such as the contracting by the telephone. In addition, this has a role to play in our lives particularly in the light I’d spread of Corona virus. Due to the lack of legislative texts that control these outputs, it has been found that it is necessary to consider the general rules until a certain legislation is issued and this what we have recommended.
