هدفت هذه الدراسة إلى بيان التعليل بالحكمة في قرارات الاجتهاد الجماعي المتعلقة بالمعاملات المصرفية " المرابحة والتورق"، وبهدف الوصول إلى معاجلة مشكلة الدراسة والإجابة على أسئلتها، فقد تناول الباحث معنى التعليل بالحكمة، ثـم بيـان موقف العلماء من التعليل بالحكمة وما هي ضوابطه. ثم انتقل إلى الحديث عن الاجتهاد الجماعي وبيان أهميته وضوابطه، وتطرق الباحث إلى دراسة مسألة المرابحة المصرفية ومسألة التورق المصرفي، من حيث التعريف وذكر أقوال العلماء فيها وبيان الراجح، ثم بيّن رأي المجامع الفقهية في المرابحة المصرفية والتورق المصرفي. وفي ختام البحث بيّن الباحث وجه التعليل بالحكمة في قرارات الاجتهاد الجماعي " المجامع الفقهية" المتعلقة بالمرابحة المصرفية والتورق المصرفي. وتوصلت الدراسة إلى أن المجامع الفقهية راعت الحكمة في تبني قراراتها المجمعية المتعلقة بالمعاملات المالية المعاصرة.
الملخص الانجليزي
This study aimed to explain the reasoning by wisdom in the decisions of collective diligence related to banking transactions "Murabah and Tawarruq", and in order to reach the treatment of the problem of the study and answer its questions, the researcher dealt with the meaning of reasoning by wisdom, then a statement of the scholars' position on reasoning by wisdom, and what are its controls, then moved to Talking about collective diligence and explaining its importance and controls, and the researcher touched on studying the issue of bank Murabaha and the issue of bank tawarruq in terms of definition and mentioning the sayings of scholars in it and the statement of the most correct, then he explained the opinion of the jurisprudence councils on bank Murabaha and bank tawarruq, and at the end of the research the researcher explained the rationale for wisdom in the decisions of diligence Al-Jama’i, “Fiqh Academies” related to banking Murabaha and bank tawarruq.
The study concluded that the jurisprudence councils took into account the wisdom in adopting their council decisions related to contemporary financial transactions.
