لقد عنيت الشريعة الإسلامية بالاهتمام بالنسل والذرية، ودعانا النبي إلى تحصيل النسل، والحفاظ عليه باعتباره أحد الضرورات الخمس التي جاءت الشرائع برعايتها، فحفظ النسل من الركائز الـأساسية في الحياة، ومن أسباب عمارة الأرض، وفيه تكمن قوة الأمم.
وما زالت مشكلة عدم الإنجاب هى الشغل الشاغل لكلا من الزوجين، وعوائق الإنجاب من أهم المشكلات التي تصدى لها العلم والعلماء لوضع كآفة الحلول لها، ولا يكاد يمر وقت إلا وقد توصل فيها الأطباء إلى تقنيات طبية جديدة لحل مشاكل عدم القدرة على الإنجاب، أو العقم، ولكن كثيرا ما تتعارض تلك التقنيات مع قواعد الدين والسلوك الأمر الذى يدفعنا إلى الوقوف على حكم تلك التقنيات الطبية وبيان موقف الشرع منها.
وقد جاء البحث في مقدمة، وتمهيد، ومبحثين، وخاتمة. أما المقدمة فتشتمل على أهداف البحث، وأسباب اختياره، والمنهج المتبع في كتابته، واشكالية البحث، وخطة تقسيم فصوله ومباحثه، والتمهيد وعنوانه: النسل وأهميته في الشريعة الإسلامية وقد نوهت فيه عن مقاصد الشريعة الإسلامية في حفظ النسل، وكيف وضعت الشريعة أسس للحفاظ على النسل، ثم تحدثت في المبحث الأول عن طرق تحصيل النسل في الطب الحديث وأحكامها في منظور الفقه الإسلامي، وبينت فيه أنواع الإخصاب الاصطناعي المساعد، وبعض الآثار الطبية ذات العلاقة به كبنوك النطف، وبنوك الأجنة وموقف الشرع من تلك العمليات، ثم تحدثت في المبحث الثاني: عن الرحم البديل وأحكامه، وتقنية وضع اللقيحة فى رحم صناعي، وبيان موقف الفقه الإسلامي من تلك التقنيات المستحدثة، ثم ذيلت البحث بخاتمة توصلت فيها إلى الوقوف على كيفية حفظ الشريعة الإسلامية للنسل من جانب الوجود بالنكاح، كما أنها وضعت وسنت له القوانين التى تحافظ عليه من العدم، وذلك بمنع ما يقطعه، أو يعدمه، أو يأتي به بغير الطريق المشروع، ثم عقبت على ذلك ببعض التوصيات منها: توجيه عناية الباحثين لدراسة تلك المستجدات الطبية التي تطرح اشكاليات واسعة للراغبين والمحتاجين إلى تقنيات الطب الحديثة المساعدة على الإنجاب على مختلف المستويات.

However, these technologies often conflict with the rules of religion and behavior, which leads us to stand on the ruling of these medical technologies and to clarify the position of Sharia regarding them.
The research came in an introduction, a preface, two chapters, and a conclusion. As for the introduction, it includes the objectives of the research, the reasons for choosing it, the method used in writing it, the problematic of the research, the plan for dividing its chapters and investigations, and the preface and its title: Offspring and its importance in Islamic law. Then, in the first section, I talked about the methods of obtaining offspring in modern medicine and their rulings from the perspective of Islamic jurisprudence, and explained in it the types of artificial assisted fertilization, and some of the medical effects related to it, such as sperm banks, embryo banks, and the Sharia’s position on those operations Then I talked in the second topic: about the alternative uterus and its provisions, the technique of placing the inseminated in an artificial womb, and a statement of the position of Islamic jurisprudence on these new techniques, then the research was appended with a conclusion in which I came to know how the Islamic Sharia preserves the offspring from the aspect of existence by marriage, as it was developed and enacted He has laws that preserve him from nothingness, by preventing what he cuts, or executes, or brings him by other than the legitimate way, and then I followed that with some recommendations, including: Directing the attention of researchers to study those medical developments that pose wide problems for those who want and need modern medical techniques to help them childbearing at different levels.
