من نعم الله علينا أنه خلق الإنسان وكرمه وأحسن خلقه وصوره، ولقد عنيت الشريعة الإسلامية بصحة المسلم عناية منقطعة النظير، وظهر ذلك فى نواح شتى بداء من الضرورات الخمس التي تدعوا إلى حفظ النفس من الهلاك تدرجا إلى الأحكام الفرعية المختلفة، والدنيا دار اختبار وابتلاء ومن حكمته عز وجل أنه يختبر عباده ويبتليهم بالأسقام، كما أن من جملة ما هداهم إليه كيفية الوقاية من تلك الآفات والأسقام، والتماس الأدوية النافعة لهم إذا نزل بهم داء، أو حل بهم سقم، ولقد شهد العالم خلال السنوات القليلة الماضية تطورا ملحوظة في مختلف جوانب الحياه المعاصرة ، ومع تطور التكنولوجيا شهد الطب تحولا جذريا يتبلور مع تقنيات الذكاء الاصطناعي فى عمليات التشخيص والتنبؤ بالأمراض، والطرق المثلى للعلاج، وأصبحت هذه التقنيات تنمو بشكل متزايد وتسعى هذه التقنيات المستحدثة لإيجاد طرق أسرع وأكثر كفاءة لإنجاز عمليات مختلفة يتجاوز فيها الذكاء البشرى؛ ولما لهذه التكنولوجيا من أهمية قصوى على مجتمعاتنا على كآفة الجوانب فقد عزمت الجهد فى البحث عنها واستقصاء طرقها؛ لفهم جوانبها والوقوف على الأحكام الشرعية لمفرداتها. ولقد استقيت فكرة البحث من محور الباب الثاني: الذكاء الاصطناعي والتطبيق التشريعي، المحور الخامس: دور تقنيات الذكاء الاصطناعي فى مسائل الاجتهاد الفقهي.
وقد قمت بتقسيم البحث إلى: مقدمة، وتمهيد ، ومبحثين، وخاتمة.
1- أما المقدمة: فتشتمل على أهداف البحث، أسباب اختياره، المنهج المتبع في كتابته، اشكالية البحث، وخطة تقسيمه، التمهيد: وعنونته بالتعريف بمفردات البحث، والألفاظ ذات الصلة، وأهمية الذكاء الاصطناعي، وأنواعه وفيه مطلبان، الأول: التعريف بمفردات البحث، والألفاظ ذات الصلة، والمطلب الثاني: عن أخلاقيات الذكاء الاصطناعي وأهميتها فى مجال العلاج، ثم تحدثت في المبحث الأول عن دور الذكاء الاصطناعي في التنبؤ بالأمراض وحكمه في الفقه الإسلامي، والمبحث الثاني: عن الجراحات الروبوتية وأحكامها في الفقه الإسلامي، وفي الخاتمة توصلت إلى عدة نتائج من أهمها: إن الشريعة الإسلامية لا تتعارض مع حرية البحث العلمي مادام يتوافق مع الضوابط الشرعية.

The Islamic Shari’a took care of the Muslim’s health with unparalleled care, and this was manifested in various aspects, starting from the five necessities that call for preserving the soul from destruction, gradually to the various sub-rules, The world is a place of testing and trials, and from His wisdom, the Almighty, is that He tests His servants and afflicts them with diseases, just as among the things He guided them to do is how to protect them from those pests and diseases, and to seek beneficial medicines for them if a disease befalls them, or a disease befalls them, During the past few years, the world has witnessed remarkable development in various aspects of contemporary life, and with the development of technology, medicine has witnessed a radical transformation that crystallizes with artificial intelligence techniques in diagnostic processes, disease prediction, and optimal methods of treatment, and these technologies are growing increasingly, and these new technologies seek to find faster ways. more efficient to accomplish various operations in which human intelligence exceeds, And since this technology is of paramount importance to our societies in all aspects, I have determined the effort to search for it and investigate its methods. To understand its aspects and stand on the legal rulings of its vocabulary. The idea of the research was drawn from the axis of the second chapter: artificial intelligence and legislative application, the fifth axis: the role of artificial intelligence techniques in issues of jurisprudence, I divided the research into: an introduction, a preface, two chapters, and a conclusion.
As for the introduction: it includes the objectives of the research, the reasons for its selection, the approach followed in writing it, the problem of the research, and the plan for dividing it. The first: definition of the research vocabulary, related terms, and the second requirement: about the ethics of artificial intelligence and its importance in the field of treatment. Then, in the first topic, I talked about the role of artificial intelligence in predicting diseases and its ruling in Islamic jurisprudence.
The second topic: about robotic surgeries and their rulings in Islamic jurisprudence. In the conclusion, I reached several results, the most important of which is: Islamic law does not conflict with the freedom of scientific research as long as it is compatible with Sharia controls.
