الحمد لله والصلاة والسلام على رسول الله، وبعد:
فإن فهم منطلقات الأئمة وقواعدهم في الاجتهاد، ومناهجهم في الفتوى، وطرائقهم في معالجة فقه النوازل، من أهم الأمور المعينة على ضبط الاجتهاد في قضايا النوازل، وقد تناول البحث في هذا الصدد جملة من القضايا، ومن أبرزها: التعريف بفقه النوازل وبيان أقسامه، وأنه يشمل نوازل العبادات، والمعاملات، ونوازل سياسية، ونوازل طبية، ونوازل في أحكام الأسرة والمرأة، ونوازل في الجنايات والحدود والأطعمة، ونوازل في قضايا أخرى مختلفة، كما تناول البحث أهمية فقه النوازل، وفوائد دراسته، وخصائص الفقه النوازلي عند المالكية، والتي تتمثل في (الواقعية، والمحلية، والتجديد، وتنوع التأليف وغزارته، وتعدد مناهجه، وبث روح الاجتهاد والاستنباط، ومراعاة الأعراف والتطورات المجتمعية؛ الظرفية أو النسبية)، وذكر البحث جملة من القواعد المنهجية للفقه النوازلي عند المالكية، وهذه القواعد هي (استعمال القياس، واعتبار العرف والعادة، وما جرى به العمل، والعمل بالمصالح المرسلة، والاستحسان، وسد الذرائع، ومراعاة الخلاف)، وكان المنهج المتبع في هذا البحث هو المنهج الاستقرائي التحليلي.

The understanding of the imams’ views points and rules of Ijtihad (independent judgment), approaches of Fatwa and methodologies of addressing contemporary issues jurisprudence is one of the most important matters used to control Ijtihad in contemporary issues. The Research addressed several issues, including: contemporary issues jurisprudence definition and its sections. The contemporary issues jurisprudence includes the contemporary issues of worship rituals, transactions, politics, medicine, family and women terms, criminal issues, prescribed penalties and food and other various issues. The Research also addressed the importance and study benefits of the contemporary issues jurisprudence and its properties in Maliki Thought. The properties are (realism, locality, innovation, diversity and abundance of authorship, variety of approaches, Ijtihad and deduction revitalization, consideration of custom and societal updates, whether circumstantial or relative). The research included a set of methodological rules of the contemporary issues jurisprudence in Maliki Thought, which are (analogy, consideration of custom and tradition, applicable conventions, public interests, (juristic discretion privilege) Istihsan, prevention of evasive devices and dissidence consideration). The inductive analytical approach is the approach applied in the Research.
