يقدم هذا البحث دراسة لمصادر الفتوى عند الشّناقطة حيث يعرض فيه الباحث لتبيان منهج الشناقطة في الإفتاء، ويسعى للوقوف على حقبة علميّة زمنيّة ذات أهميّة خاصة، واستخلاصه لتجربة علماء أجلاّء ودورهم في التّصدي للنّوازل بالفتوى المؤصّلة من خلال بحث السمات المميزة للفتوى الشّنقيطيّة.
فموضوع الفتاوى والنّوازل -ومنها الفتاوى الشّنقيطيَّة-من الموضوعات الفقهية التي اهتم بها العلماء قديما وحديثا ونالت من الباحثين في كل عصر وجيل قِسطا موفورا من البحث والتّحقيق، فعملوا على إمعان النّظر فيها وبذلوا جهدا مشكورا في تحريرها وتدوينها وتصنيفها، غير أنّ دراسة مصادرها وسماتها مازالت تحتاج لكثير من البحث والدّراسة والتّتبع، وفي هذا السياق يتنزل هذا البحث العلمي ليكشف المنهج الشنقيطي في الإفتاء ويبين كيف أنّ البيئة الشّنقيطيّة البدويّة، كانت لها خصوصيات كثيرة، وإكراهات متنوعة، فرضت على فقهائها إيجاد أجوبة شرعيّة شافية ومقنعة، لكل ما يُطرح فيها من قضايا ونوازل، دون الجمود على ما هو مسطور في كتب المتقدمين، التي تم تأليف أغلبها في بيئات مدنية مغايرة كثيرا للبيئة الشّنقيطيّة.

This research investigates sources of the fatwas of the Shanaqita. Thus, the researcher hereby presents the approach of Shanaqita in issuing a fatwa. Likewise; the researcher seeks to clarify a scientific era of particular importance, and concludes the experience of the dignified scholars and their role in addressing the controversial issues by the genuine fatwa. Moreover, the study explores the distinctive characteristics of the Shanqita for Fatwa issuance.
Previously like in the present time, scholars have paid huge attention to the subject of fatwas and calamities – such as “the Shanqeeti fatwas”. Consequently, the subject has considerably attracted the researchers’ attention in every era and generation. Thus, they worked carefully on it and made a commendable effort in editing, writing and classifying it. Despite the extensive and useful contributions to the subjection matter, the investigation of related sources to it remains insufficient to the best knowledge of the researcher. Unlike the previous studies, the recent study aims to fill the research gap as mentioned above by revealing the Shanqeeti approach to fatwas and showing how the peculiarities of Shanaqite rural areas. The study also seeks to explore the constraints that triggered the jurists of the respective area to find legitimate, satisfactory and convincing answers to all issues and cases that rose among the society members. In doing so, they kept themselves far away from any rigid imitation of ideas available in old books were written in urban environments which differ from the Shanaqite environment
