تتناولت هذه الدراسة موضوعاً مهماً يتعلق بالزواج والولاية على المرأة واشتراط الولي لتزويج المرأة ،ومحاولة
توضيح ما يتعلق بهذه المسألة سواء في الجانب الفقهي أو القانوني وبالتحديد المعمول به في المحاكم السودانية ،
وتهدف هذه الدراسة لتوضيح أهمية الولاية على المرأة وكذلك بيان أثر الولي قبل وبعد الزواج. واختلاف الفقهاء حول
ولاية المرأة على نفسها في الزواج.

This study addressed an important issue concerning marriage and the guardian to marry
women, and to try to clarify what is the related to such question, whether in the doctrinal or
legal status and specifically the trend in Sudanese courts. The aim of this study was to
illustrate the importance of the mandate on women and also indicate the role of the guardian
