تهدف هذه الدراسة إلى محاولة توضيح جريمة الإتجار بالأعضاء البشرية ضمن نطاق القانون الدولي و الشريعة الإسلامية
وقد قمنا بتقسيمها لجزئين، في الجزءالأول تحدّثنا عن تجريم الإتجار بالأعضاء البشرية في القانون الدولي ، أين و ّضحنا
دور المنظمات الدولية في تجريم الإتجار بالأعضاء البشرية، وكذا تجريم الإتجار بالأعضاء البشرية في نطاق الإتفاقيات
الدولية.
أما الجزء الثاني من هذه الدراسة فقد تركناه لتوضيح تحريم الإتجار بالأعضاء البشرية ضمن مبادئ الشريعة الإسلامية،
وفيه تحدّثنا عن طبيعة صلة الإنسان بجسده و تبيان حرمة الجسد الآدمي في الفقه الإسلامي، و كذا أنواع التصرف في
الأعضاء البشرية و حظر التجارة فيها في الفقه الإسلامي، كما ختمنا دراستنا هذه بخاتمة تض ّمنت بعض النتائج و

This study aims to clarify the crime of human organs trafficking under international law and Islamic
Sharia. We divided it into two parts: in the first part, we talked about the criminalization of trafficking
in human organs in international law, where we explained the role of international organizations in the
criminalization of trafficking in human organs, as well as the criminalization of trafficking in human
organs under international conventions.
In the second part of this study we left to clarify the prohibition of human organ trafficking in the
principles of Islamic Sharia where we talked about the nature of human contact with his body, and
demonstrate the sacredness of the human body in Islamic jurisprudence, and the types of behavior of
human organs, and the prohibition of trade in human organs in Islamic jurisprudence. in conclusion, we
present the proposed results and recommendations.
