تهدف هذه الدراسة إلى بيان ونقد موقف إحدى أكبر التيارات الفكرية المعاصرة من مقاصد الشريعة بشكل عام والمصلحة بشكل خاص، وقد خلصت الدراسة في بيان ونقد موقف الحداثيين من المصلحة إلى: أن الحداثيين يطلقون العمل بالمصالح دون أي ضوابط، ويحاولون الاحتكام إلى المقاصد دون النصوص، وحاولوا التفلت من الأحكام الشرعية والتمرد على النصوص بحجة أن هذه الأحكام خاصة لحقبة زمنية وظروف بيئية معينة، وإن الأولى مراعاة مصلحة الواقع.

This study aims to present and discuss the stand of one of the biggest contemporary movements towards the syariah maqāsid (objectives) in general and towards the maslahah (benefit) in particular. The finding of the study is that the modernist tend to apply the concept of masālih without discipline and they tend to regard maqāsid as the main source of ruling without taking the sacred religious texts into consideration. They try to free themselves from syariah law and its sources by presenting the argument that syariah law was suitable only for a specific period of time and as far as our age is concerned, it is important to understand the reality of life of the recent era and to act upon it.
