فإن للأحكام الشرعية والسنة النبوية أبعاد حضارية سامية تهدف إلي تحقيق السلم
الَجتماعي والرقي البشري. ومن هذه الأبعاد الحضارية العناية بِلْار والْوار, فنص القرآن
الكريم والأحاديث النبوية على حقوق للجار تتفاوت بحسب قرب الْار وبعده في الْوار.
كما أن الْار استحق هذه الحقوق من الحقوق العامة المكفولة للمسلم من أخيه المسلم .
وهذا البحث يركز على ما ورد في السنة النبوية من هذه الحقوق, فقد ورد فيها أوامر
بِلإحسان إلي الْار وإكرامه ومعاهدته, كذلك وردت نصوص تنهى عن إيذاء الْار
والإضرار به والتعدي على حقوقه.
فهذه النصوص تهدف في جملتها إلي تحقيق السلم المدني والأمن الَجتماعي وبِلمقابل صيانة
المجتمع من ما يخل بأمنه واستقراره. ومن نًحية أخرى تمثل جانبا من جوانب حقوق
الإنسان في أن يعيش عيشا آمنا ,ولَ يتأثر بفقد عشيرته وصلة رحمه ولَ يُس بِلوحدة
والعزلة. وهي كذلك تهدف إلي وحدة الإنسان والإنسانية.
ولما كان للأمر والنهي دلَلَت عند الفقهاء الأصوليين فالأصل في الأمر عندهم للوجوب
والإلزام ويدل على الندب والَستحباب بقرينة,والأصل في النهي التحريم ويدل على الكراهة
والتنزيه بقرينة. فالبحث وقف على بعض نصوص السنة التي ورد فيه أمر بحق للجار أو نهي
عن ما ينافي هذه الحقوق بهاتين الصيغتين أعني صيغتي الأمر والنهي وتعرف على – –
دلَلة الحكم منهما.
