يعتبر التراضي ركنا مهما في إبرام وتنفيذ العقود، حيث يهدف البحث في خصوصية ركن التراضي في عقد التجارة الالكتروني إلى البحث في مدى جوازية التعبير عن هذه الإرادة بواسطة الإيجاب والقبول بالطرق الالكترونية خاصة وأن القانون الجزائري يخلو من أحكام خاصة تنظم قانون التجارة الالكترونية. وخلصت هذه الدراسة إلى اهتمام المشرع بركن التراضي وإقراره لصحة الإيجاب والقبول في عقود التجارة الالكترونية في القواعد العامة، وتحديد وسائل التعبير عنهما على غرار بعض التشريعات والأجنبية التي اهتمت بركن التراضي وسبل التعبير عنه القوانين الخاصة، لتسهيل عملية إبرام العقود وتنفيذ المبادلات في مجال الممارسات التجارية الالكترونية.
