تروم هذه الدراسة الكشف عن بعض مظاهر التجديد والاجتهاد ، باعتماد آليات التفكير وأصول الاستنباط، في فقه الإمام أبي الوليد ابن رشد (تـ 595هـ)، من خلال كتابه "بداية المجتهد وكفاية المقتصد"، مع بيان كيفية مراعاة قواعد المقاصد في اجتهاداته باعتبارها شرطا وضابطا أساسيا يلزم المجتهد مراعاته أثناء عملية الاجتهاد، مبرزا بذلك منهجه الذي لا يكتفي فيه بإيراد الأقوال المختلفة التي نتجت عن اجتهادات الفقهاء؛ وإنما يبذل وسعه الفكري وطاقته العقلية، لبيان العملية التي سلكها كل فقيه من حيث الأصول التي اعتمدها، وبنى عليها اجتهاده، مرجحا للأقوال والمذاهب بناء على ضابط المصلحة في كثير من المسائل، ولو خالف بذلك مذهب مالك، ثم أعقبت ذلك بنماذج وأمثلة تطبيقية تجلي للقارئ كيفية تنزيل الأصول والقواعد الاستنباطية في دراسته لكل المسائل الفقهية خصوصا في قسم المعاملات.

This study aims to reveal the manifestations of innovation and diligence, by adopting the mechanisms of thinking and the principles of deduction, according to Imam Abu Al-Walid Ibn Rushd (d. 595 AH), in his book “The Beginning of the Mujtahid and the Sufficiency of the Muqtasid,” with an explanation of how to take into account the objectives in Ibn Rushd’s jurisprudence, as they are a basic condition and control that binds the mujtahid. By taking it into account during the process of ijtihad, highlighting his approach in which he is not satisfied with citing the various opinions that resulted from the jurisprudence of jurists; Rather, he exerts his intellectual capacity and mental energy to explain the process followed by each jurist in terms of the principles that he adopted and based his diligence on, giving weight to the opinions and doctrines based on the criterion of interest in many issues, even if in doing so he contradicted Malik’s doctrine, then I followed that with practical models and examples to make clear to the reader how.
