Considering the purposes of Sharia in fatwas about epidemics and diseases

The taxpayer is the focus of Sharia rulings, and the focus of Sharia rulings is to take care of the taxpayer in terms of achieving his interests and warding off the harm and harm caused to him or expected to his rights, and this research study deals with an aspect of Sharia’s care for those interests and it comes under the title: (Considering the objectives of Sharia in fatwas of epidemics and diseases).

The study has been organized into the importance of the research, its objectives, the methodology that I will follow in writing it, and the expected results.

The importance of research: the importance of research comes:

1- From the attention of Islamic law to the provisions of facts and developments

2- The research falls within the auspices of the Sharia to preserve the human soul, and it is one of the five necessary objectives and faculties.

3- The importance of the topic comes in light of the spread of diseases and epidemics that afflicted humanity and killed many people (Coved 19) as a model

research aims:

1- Explaining the relationship of the objectives of Sharia with the fatwa and the mufti.

2- Explaining the methods of the jurists devising jurisprudential rulings in light of the objectives of Sharia and building the fatwa on them.

3- Explaining the effect of the objectives of Sharia and their role in the fatwa, and the controls related to this.

4- Explain the interest of Sharia in the lives of people and the human aspects.

Research Methodology:

I will follow in writing this research - God willing - the descriptive and analytical approach

إنَّ المكلف هو محور الأحكام الشرعية وإن مدار الأحكام الشرعية هو رعاية المكلف من حيث تحقيق مصالحه ودفع المفاسد والمضار اللاحقة به أو المتوقع لحوقها، وهذه دراسة بحثية تتناول جانباً من رعاية الشريعة لتلك المصالح وهي تأتي بعنوان : (اعتبار مقاصد الشريعة في فتاوى الأوبئة والأمراض).

وقد انتظمت الدراسة أهمية البحث واهدافه والمنهج الذي سأتبعه في كتابته والنتائج المتوقعة .

أهمية البحث: تأتي أهمية البحث :

1- من عناية الشريعة الإسلامية بأحكام الوقائع والمستجدات

2- يقع البحث ضمن رعاية الشريعة لحفظ النفس البشرية وهو من المقاصد الضرورية والكليات الخمس.

3- تأتي أهمية الموضوع في ظل انتشار أمراض وأوبئة أصابت الإنسانية وأودت بحياة كثير من البشر (Coved 19) نموذجاً

أهداف البحث:

1- بيان علاقة مقاصد الشريعة بالفتوى والمفتي.

2- بيان طرق استنباط الفقهاء للأحكام الفقهية على ضوء مقاصد الشريعة وبناء الفتوى عليها.

3- بيان أثر مقاصد الشريعة ودورها في الفتوى والضوابط المتعلقة بذلك.

4- بيان اهتمام الشريعة بحياة الناس والجوانب الإنسانية.

منهج البحث:

سأتبع في كتابة هذا البحث – إن شاء الله – المنهج الوصفي التحليلي
