يعد التفكك الاسري احد الافات التي تهدد المجتمع وخصوصا الاطفال اذ اثبتت الدراسات العلمية ان التفكك الاسري هو السبب الرئيسي في جنوح الاحداث , وعلى الرغم من ان المشرع العراقي اولى الاسرة الاهمية وذلك بنصوص كثيرة في قوانين متفرق الا ان تلك النصوص قاصرة عن اداء مهتها وخصوصا بعد التطور الكبير الذي طال المجتمع العراقي , اذ افرز الواقع حالات بمنتهى الخطورة على الاسرة وخصوصا حالات العنف الاسري الامر الذي يتطلب سن تشريعات خاصة لحماي الاسرة ومناهضة العنف الاسري.
