تهدف هذه الدراسة إلى إبراز الجوانب السلبية للمستوطنات الإسرائيلية على البيئة الفلسطينية، حيث تم تسليط الضوء على قطاع (النفايات الخطرة). وتم الاعتماد في إعداد الدراسة على المنهج الوصفي التحليلي، وعلى الإحصاءات البيئية المحلية، التي يوفرها الجهاز المركزي للإحصاء الفلسطيني، والمراكز البحثية، إضافة إلى بعض المصادر والمراجع والدراسات ذات العلاقة.
وأظهرت نتائج الدراسة أن الاحتلال الإسرائيلي، قام من خلال أجهزته وأدواته المختلفة، بانتهاك حقوق الإنسان كافة، وجميع المواثيق والمعاهدات الدولية بمختلف تسمياتها، ولعل من أخطرها تدميره المتعمد للبيئة الفلسطينية، وانتهاكه لاتفاقية بازل الدولية، وذلك بتهريبه للمخلفات الخطرة، السائلة والصلبة، إلى الأراضي الفلسطينية المجاورة لها، والتي تؤدي بالتالي إلى تشويه البيئة في المناطق المحاذية، وتدميرها.
وأوصت الدراسة بضرورة مطالبة الطرف الإسرائيلي بدفع تعويضات عن الأضرار البيئية، التي تنجم عن مخلفاته الخطرة في الأراضي الفلسطينية، وفي حالة عدم الاستجابة، تتم دراسة إمكانية التقدم إلى أطراف دولية، أو إلى المحاكم الدولية، كمحكمة العدل الدولية مثلًا، على غرار ما تم بخصوص جدار الفصل العنصري، بحيث يتم توثيق جميع حالات الانتهاكات الإسرائيلية ومجالاتها في مجال البيئة، في أرجاء فلسطين كافة.
الملخص الانجليزي
This study aimed at highlighting the negative aspects of Israeli settlements on the
Palestinian environment. The sector (hazardous waste) was highlighted . The study was based
on the analytical descriptive approach, and relying on the local environmental statistics
provided by the Palestinian Central Bureau of Statistics and the research centers, in addition to
reference to several sources, references and related studies.
The results of the study showed that the Israeli occupation of the Palestinian territories, through
its various apparatuses and tools, violated all international conventions and conventions in all
their names. The most dangerous of these was the deliberate destruction of the Palestinian
environment, and the violation of the International Basel Convention by smuggling hazardous
and solid waste to the Palestinian territories, which are therefore in the process of distorting
and destroying the environment in the adjacent areas.
The study recommended that the Israeli side should pay compensation for the environmental
damage caused by its hazardous waste in the Palestinian territories. In case of non-response,
the possibility of applying to international parties or to international courts (eg the International
Court of Justice) So that all cases and areas of Israeli violations in the field of the environment
are documented throughout Palestine.
