يعد موضوع التناظر ذا الطابع الفلسفي من اهم موضوعات القانون التجاري، إذ تدرس هذه النظرية لوضع أساس لأغلب النظم القانونية الحالية المطبقة في الشركات، إذ كعادتها تسعى أنظمة السابقة القضائية إلى البحث عن فلسفة قديمة لتبني عليها أفكاراً قانونية حديثة، ويعد موضوع التناظر كفلسفة منشأ للعديد من هذه التطبيقات مثل حوكمة الشركات، المسؤولية الاجتماعية للشركات وأخيراً مواطنة الشركة.

The subject of Analogy between States and Firms with its philosophical nature is one of the most important topics of commercial law. This theory is considered to lay the foundation for most of the current legal systems applied in companies. As usual, the common law system seeking an old philosophy to establish on them modern legal ideas. The subject of Analogy as a philosophy considered as the origin of many of these legal applications such as corporate governance, corporate social responsibility and finally corporate citizenship.
