خصوصيات المتهم الحدث خلال مرحلة التحقيق: دراسة مقارنة بين القانون العراقي واللبناني

This research deals with the privacy of the Juvenile accused during the investigation stage in the Iraqi and Lebanon juvenile law. Its purpose is to clarify the similarities and differences between the laws of juveniles of both countries in relation to the subject matter of the study, in order to take advantage of the strengths of each law. The study concluded with results: the similarity between the two laws on certain issues, such as granting the discretionary power to the investigating judge to arrest juvenile accused in cases of misdemeanors and felonies, the closure of the investigation to the Juvenile accused because of aging out of the crime. On the issues of disagreement, the case for argument was in favor of Lebanon law on certain issues, such as the juvenile who has not completed the age of 12 years may not be arrested. On other issues, the balance was the odds in favor of Iraqi law, such as exempt the juvenile from fingerprinting and as a result, the measures against him are not considered judicial precedents. الملخص: يتناول هذا البحث خصوصيات المتهم الحدث خلال مرحلة التحقيق في قانون الأحداث العراقي واللبناني. والغرض منه هو بيان أوجه التشابه والاختلاف بين قانون الأحداث لكلا البلدين فيما يتعلق بموضوع الدراسة، بهدف الاستفادة من نقاط القوة في كل قانون. واختتم البحث بنتائج وهي: التشابه بين القانونين في بعض المسائل، مثل منح السلطة التقديرية لقاضي التحقيق في توقيف المتهم الحدث من عدمه في جرائم الجنح والجنايات، وغلق التحقيق بحق المتهم الحدث لتقادم الجريمة، والاختلاف في مسائل أخرى. وبخصوص مسائل الخلاف، فإن كفة الرجحان كانت لصالح القانون اللبناني في بعض المسائل، مثل عدم جواز توقيف الحدث الذي لم يكمل الثانية عشرة من عمره. وفي مسائل أخرى، كفة الرجحان كانت لصالح القانون العراقي، مثل إعفاء الحدث من أخذ بصمة أصابعه وبالنتيجة عدم اعتبار التدابير الصادرة بحقه سوابق قضائية.
