ملخص البحث
تهدفُ هذهِ الدارسةُ إلى إيجادِ آليَّةٍ عمليةٍ لتطبيقِ أحكامِ البيوعِ منْ خلالِ قواعدِ أنظمةِ الجودةِ المعمولِ بها حالياً، وتؤكِّدُ الدِّراسةُ من خلالِ المباحثِ الَّتي تناولَها الباحثُ على اختبارِ الفروضِ التاليةِ :
أولاً : هناكَ توافقٌ كبيرٌ بينَ مفهومِ الجودةِ الشاملةِ، وبينَ أحكامِ البيوعِ الَّتي تَعْتَبِرُ التراضيَ منْ أركانِ البيعِ .
ثانياً : تفترضُ الدِّراسةُ عدمَ وضوحِ أحكامِ فقهِ البيوعِ لعامَّةِ التجارِ والمتعاملينَ .
ثالثاً : ترى الدِّراسةُ أنَّ أحكامَ البيوعِ نظامٌ تشريعيٌّ ماليٌّ راقٍ يحاكي أفضلَ الأنظمةِ على الإطلاقِ؛ بلْ يتفوَّقُ عليها.
وقدْ ثبتَ منْ خلالِ الدراسةِ تأكيدُ فرضيةِ التَّوافقِ، وحصرُ نقاطِ الاختلافِ غيرِ المؤثرةِ على تطبيقِ أحكامِ البيوعِ كنظامِ جودةٍ إسلاميٍّ خاصٍّ بالمعاملاتِ التجاريةِ.
أما الفرضية الثانية؛ فقدْ أكدتِ الدَّراسةُ الميدانيةُ ضعفَ الجانبِ الشرعيِّ وحاجةَ السُّوقِ لمؤسسةٍ تأهيليَّةٍ رقابيَّةٍ، مما يزيدُ أسهمَ الفرضيةِ الثالثةِ؛ والتي أكَّدَها الباحثُ منْ خلالِ إثباتِ قواعدَ ومعاييرَ فقهيةٍ للجودةِ، موضحاً بعضَ السُّبلِ والآلياتِ لأكاديمياتِ البحثِ الشرعيةِ، والمجامعِ الفقهيةِ، وخُتمتِ الدراسةُ بتوصياتٍ مرتبطةٍ بنتائجِ البحثِ؛ أهمها :
1 - لا تعني هذهِ الدراسةُ سدَّ بابِ الحاجةِ للدراسةِ في هذا المجالِ .
2 - الأُمَّةُ بأمسِّ الحاجةِ لمثلِ هذهِ التقنيناتِ التي تحفظُ للأمةِ ريادتَها، وتقودُ إلى موافقةِ شرعِ ربِّها.
3 - لضمانِ قوّةِ هذهِ الآليةِ يقترحُ الباحثُ أنْ تكونَ ضمنَ إدارةٍ مباشرةٍ منْ مؤسَّسةٍ تُعنى بالتعليمِ الأكاديميِّ الشرعيِّ .

ABSTRACT
This study aims to find practical mechanism to implement the provisions of sales through quality systems rules currently in force and the study confirms through the detective addressed by the researcher to test the following hypotheses:
First: There is a large consensus between the concept of Quality Comprehensive, and the provisions of the Financial Transactions which Consensus and compromise is one of the pillars of sales.
Second: The study assumes the lack of clarity in the provisions of »Figh» the jurisprudence of sales to the general merchants and dealers.
Third: The study finds the provisions of the sales is legislative and sophisticated financial system that simulates the best systems at all, but to be outdone also.
Has been proven through the study confirm the hypothesis compatibility, and to infinite points of difference non-influential on the implement of the provisions of the sales as a quality of an Islamic private commercial transactions The second hypothesis; the field study has confirmed the weakness at the legitimate and the need of the market for Rehabilitative institution supervisory, which increases the shares of the third hypothesis; That confirmed by the Researcher by demonstrating the doctrinal norms and standards of quality, explaining some of the ways and mechanisms for legitimate research academies, and Fiqh Councils, the study concluded with recommendations linked to search results, including:
1 - This study does not mean to close the door of any additional needs in this field.
2 - The nation's desperately need for such techniques that preserve the nation's leadership and God almighty proceeded approval.
3 - To ensure the strength of this mechanism the researcher is proposed to be under the direct management of the institution means to legitimate academic education.
