الحمد لله حمداً يوافي نعمه ويدفع عنا بلاءه ونقمه، والصلاة والسلام على من لا نبي بعده، وعلى آله وصحبه ، وبعد: يتناول هذا البحث موضوع أحكام المصابين بالتوحد في العقوبات الجنائية، وهو من القضايا المهمة، خاصة بعد انتشاره بكثرة في مجتمعنا المعاصر، إذ يتميز المصاب بالتوحد في اغلب الحلات بالعزلة والاكتئاب والسلوك العدواني، وفي بعض الحالات محاولة المصاب بالتوحد للانتحار نتيجة لما يمر به من ضغوطات نفسية، فكان هذا البحث لتوضيح لما يترتب على المصاب بالتوحد من العقوبات الجنائية نتيجة لجنايته على النفس أو ما دونها، وبيان أحكامه الشرعية، وبيان حكم الإسلام وآراء الفقهاء في أهلية المصاب بالتوحد، وقد افتتح بمبحث موجز خُصص للتعريف باضطراب التوحد مع بيان مدى أهلية المصاب به، فقد يكون كامل الأهلية أو ناقص الأهلية أو فاقد الأهلية بحسب تأثير الاضطراب على إدراكه وتمييزه، ثم المبحث الثاني والذي يوضح فيه نوع العقوبة المترتبة على المصاب بالتوحد نتيجة لجنايته على النفس أو ما دونها، وموقف الشريعة الإسلامية في حال اعتدائه على غيره .
