تتناول هذه الدراسة رعاية المصالح في عصر الخلفاء وأثرها في الفقه السياسي المعاصر، فالأصول الأساسية والقواعد الكلية والنصوص القطعية كلها تهدف إلى رعاية مصالح الناس وتحقيق الخير لهم، فكل ما جاء به الشرع من الأمر بالعدل والاحسان والنهى عن الفحشاء والمنكر، فهو مصلحة يسعى الشرع إلى رعايتها وتكميلها، وكل ما كان غير ذلك فهو مفسدة نهى عنها، فالخلفاء رعوا مصالح الأمة في واقعهم السياسي خلال فترة حكمهم من خلال المحافظة على المصالح الضرورية، وحرصهم على تقديم المصالح العامة على المصالح الخاصة .
الملخص الانجليزي
This study deals with the interest of interests in the era of the caliphs and their impact on contemporary political jurisprudence. The basic principles, the rules and the peremptory texts are all intended to take care of the interests of the people and achieve good for them. All that is stated in sharee'ah is from the matter of justice and charity and forbidding indecency and evil. The caliphs sponsored the interests of the nation in their political reality during the period of their rule by maintaining the necessary interests and their keenness to provide public interests to the private interests.
