ملخص
إن استخدام جهاز الهاتف النقال باليد أو حتى بواسطة السماعة أثناء قيادة المركبة الآلية يعد من الظواهر الاجتماعية السلبية القديمة نسبياً، وقد سعى المجتمع بكافة أجهزته إلى معالجتها بالوسائل المتاحة بما في ذلك الوسائل القانونية التي لم تجدِ نفعاً بالنظر إلى حال الشارع الكويتي على وجه التحديد، فما زالت هذه القضية من بين المشكلات التي تحصد أرواح وممتلكات مستخدمي الطرق بسبب عدم التزام الكثير من الناس باحترام قواعد السلامة المرورية، فآثرنا طرح هذه المشكلة لنناقش فيها مدى الحاجة الملحة إلى تغيير السياسة المرورية الحالية التي بدأت تضمر مع مرور الزمن وذلك من خلال بوابة تشديد العقوبات الجزائية والإدارية على مستخدمي الهاتف أثناء القيادة لضمان تحقيق فكرة الردع وذلك لضمان احترام قواعد السلامة المرورية من ناحية، والحفاظ على أرواح مستخدمي الطرق وممتلكاتهم من ناحية أخرى. لذلك سنعرض مشكلة استعمال الهاتف باليد أثناء القيادة في الواقع المروري لدولة الكويت وأسباب انتشارها وخطورتها على مرتادي الطرق، ثم بعد ذلك نحلل طبيعتها القانونية كسلوك إجرامي يتوافق مع ما تقرره الأحكام الواردة في التشريع الجزائي الكويتي لنختم بحثنا بعرض ما توصلنا إليه من نتائج وتوصيات.

Summary
The use of the mobile phone by hand or even by the headset while driving the vehicle is one of the negative social phenomena to be relatively old, and the society with all of its agencies have sought to deal with it through all available means, including legal means that did not work in view of the situation of the Kuwaiti street in particular, This case is still one of the problems that kill the lives and destroy road users property because many people do not comply with respect the rules of traffic safety. So, we have raised this problem to discussing the urgent need to change the current traffic policy, that began to disappear over time, through the way of tightening penal sanctions on mobile phone users while driving to ensure that the policy of deterrence is implemented in the manner that ensures respect for the rules of traffic safety on one hand, and preserve the lives and property of road users on the other hand. Therefore, we will present the traffic situation in Kuwait and explain the reasons behind its spread, and then we will analyze the legal nature of the behavior of mobile phone use by hand during driving and its applicability with the description of criminal crime, and thus raising the limit of punishment to reach the ultimate goal of presenting results and recommendations.
