تشتمل هذه الدراسة على تحقيق ودراسة رسالة "فتح الجليل على عبده الذَّليل في بيان ما ورد في الاستخلاف في الجمعة من الأقاويل" لنوح بن مصطفى القونوي الرُّومي (ت:1070هـ)، كان المؤلف عالـمًا كبيرًا، وفقيهًا متميزًا، تصدر للإفتاء بمدينة قونية، وقد ساهم إسهامات علمية جليلة في مجال التأليف، وقد قمت بتحقيق رسالته؛ معتمدًا في ذلك على نسختين خطيتين، حصلت عليها من مكتبة ولي الدين أفندي التابعة للمكتبة السليمانية باسطنبول. تعتبر هذه الرسالة من الرسائل الفقهية على مذهب الإمام أبي حنيفة النعمان رحمه الله، تناولت موضوع حكم استخلاف الخطيب يوم الجمعة، وقد كتب في هذا الموضوع كثيرٌ من فقهاء الحنفية المتأخرين؛ منهم ابن كمال باشا وملا خسرو وحسن الشرنبلالي وغيرهم؛ وكان من بين من شارك في بحث هذه المسألة الإمام نوح القونوي، فقام بدراسة المسألة من خلال إيراد نقولات العلماء، مع مناقشة من خالفه في رأيه بمنهجية علمية هادفة، وأسلوبٍ علمي رصين، وخلص في نهاية بحثه إلى أنه لا فَرْقَ في جوازِ الاستخلاف بين الـخطبة والصَّلاة، سواءّ كان الخطيب معذورًا أو غير معذور.

This study comprises the analysis and the exploration of a paper named " Fethu’l-ǧālil alâ abdihi’z-zelîl fî beyâni mâ werede fi istihlâf ẖatib mine’l-ekâwîl’ for Nūḥ ibn Muṣṭafa al-Qūnūy who died in 1070 A.H/1660. He was a great scholar, author, and a professional and unique faqīh. He held the position of deliverance of advisory opinions in the city of Qūnīh and moved to Egypt for preaching and teaching. He has contributed an impressive amount of scientific contributions in relation to writing and authorship which has enriched the Islamic library with many useful books and publications especially in the field of Islamic Fiqh and concepts. Therefore, I have analysed and examined his written work ‘Fethu’l-ǧālil alâ abdihi’z-zelîl fî beyâni mâ werede fi istihlâf ẖatib mine’l-ekâwîl’ based on two handwritten copies which I have found from the library of Wli al-Dīn ʾfandy which belong to the library of al-Sulaymānyah in Istanbul. This letter is one of the Jurisprudencial letters based on the doctrine of Imam Abū Ḥanīfa al-Nuʿmān (may Allaah have mercy on him), which dealt with the issue of taking someone other than the Khatib (the preacher) to succeed him during The sermon of Friday, many of the late Hanafi scholars have written in this subject, including Imam Ibn Kamal Pasha, Imam Mullā Khüsrew, Imam Hasan al-Shurunbulali and others; among those who participated in the research of this issue: Imam Nūḥ ibn Muṣṭafa al-Qūnūy, our author tried to explain the opinion adopted by him in the matter, mentioning the scholars sayings on the subject on the whole, and discussing who disagreed with him in his opinion a purposeful scientific discussion, in a discreet scientific method, and concluded at the end of his research that There is no difference in the permissibility of succession between the sermon and the prayer, nor between the excuse and the non-excuse.
