تعد حرية الاجتماع والتظاهر من الحريات الأساسية التي أقرتها معظم الدساتير في العالم، وهي قناة من قنوات تبادل الآراء، ووسيلة من وسائل ممارسة حرية الرأي والتعبير، والأخيرة لا يجوز فصلها عن أدواتها ووسائل مباشرتها، فمثل هذا الفصل يؤدي إلى فقد حرية الرأي قيمتها ومغزاها. غير أن تقرير حرية التجمع والتظاهر – كغيره من الحقوق والحريات الأساسية -وتأكيد كفالته في المواثيق الدولية والدساتير لا يعني إطلاقه بغير حدود أو قيود، فالحقوق إذا لم تمارس فـي حدود وضوابط في إطار سلطة منظمة لانقلبت بالضرورة إلى فوضى. لذلك تحرص الدول على تنظيم ممارسة مثل تلك الحقوق ورسم نطاقها وحدودها على أن يكون ذلك في أضيق الحدود ولأشد الضرورات.

Freedom of assembly and demonstration is one of the basic freedoms approved by most constitutions in the world, and it is a channel for exchanging opinions, and one of exercising freedom of opinion’s tools, and freedom of opinion may not be separated from the tools and means which are directing it, such separation results that freedom of opinion losses its value and significance. However, granting freedom of assembly and demonstration - like other fundamental rights and freedoms - and affirming its guarantee in international conventions and national constitutions does not mean its launch without limits or restrictions. Rights, if they are not exercised within limits and controls within the framework of organized authority, will necessarily turn into chaos. Therefore, states are keen to regulate the exercise of such rights and draw their scope and borders, provided that this is strictly minimal and necessary
