خص المشرع الجزائري الحدث الجانح أو المعرض للجنوح بسبب ظروفه الاجتماعية و الأسرية أو أي ظروف يمكن تؤدي إلى جنوحه ,بإجراءات وقائية حمائية قبل الجنوح و هو ما استعمل المشرع لوصفه مصطلح الحدث في خطر معنوي وفقا لقانون حماية الطفولة 15/12 الصادر في 15/07/2015 ، و خص المشرع الحدث الذي دخل مرحلة الجنوح أو تم مباشرة تحقيقا قضائيا بشأن احتمال جنوحه، بإجراءات أخرى تتم وهي أيضا تمتاز بطابع الحماية و ليس العقوبة، و تتدرج هذه التدابير بين مرحلة التحقيق و إجراءات الحماية الخاصة به ، و مرحلة المحاكمة و تنفيذ الحكم وما بعد تنفيذه ، من حيث الشدة و الخصوصية و الغاية و الهدف منها، فهدفها حماية و وقاية لإبعاد الحدث عن مسببات جنوحه .
