إن النظام الإسلامي يتصف بالعدالة والشمولية والكمال، وعدم السماح بالاستبداد
من قبل الحكام، والعدالة والقانون يرسخان مبدأ الحرية والديمقراطية، والفصل بين
السلطات يوازن تحقيق مصالح الدولة بعيدا عن كل تعسف واستبداد، ولا يتحقق هذا
الفصل بين السطات إلا من خلال تقسيم وظائف الدولة إلى وظائف تشريعية، ووظائف
تنفيدية، ووظائف قضائية كل منها على حدة. ومن هنا تكونت مشكلة الدراسة والتي
تمثلت في عدم وضوح مبدأ معين في الفصل بين السلطات في أنظمة السطات الليبية،
وتحديد موقف الإسلام من طبيعة تلك الأنظمة المتبعة فيها. وتهدف هذه الدراسة إلى
كشف اللثام عن المبدأ الأساسي المتبع في الأنظمة السياسية الليبية للفصل بين سلطاتها
على وجه الخصوص، بالإضافة إلى بيان موقف الشريعة الإسلامية من تلك المبادئ.
وتعكس هذه الدراسة أهمية تتمثل في تناولها مبدأ هاما من مبادئ الديمقراطية، بالإضافة
إلى تحقيق مصالح الدولة من خلال إتقان هيئات السلطات للعمل داخل وظائف الدولة
الأمر الذي يحقق فائدة عظيمة للمواطن الليبي على المستوى الوظيفي. وتعتمد هذه
الدراسة على المنهج الوصفي والمنهج التحليلي والتاريخي من خلال استقراء الأنظمة
السياسية المتبعة للفصل بين السلطات في الدول المتقدمة، وسيتم التركيز على الأنظمة
السياسية في ليبيا خصوصا، مما يقود إلى تحديد طبيعة الأنظمة السياسية المتبعة فيها.
