من الأحكام التي تتفرع عن مقصدي حفظ النفس والنسل معاً: الأحكام التي تتعلق بالجنين، ومن أهم هذه الأحكام مسألة الإجهاض، وقد توسع العلماء قديماً وحديثاً في بيان هذه المسألة، إلا أن التطور العلمي في مجال الطب قد فتح آفاقاً جديدةً وقدّم وقائع لم تكن معلومةً عند المتقدمين، من هذه الوقائع: إسقاط الجنين حال كون استمرار الحمل مهدداً لحياة الأم. يحاول هذا البحث الإجابة عن هذه المسألة وبيان الحكم الشرعي فيها، من خلال استقراء أقوال الفقهاء المتقدمين والمتأخرين فيها، وبالاستفادة من المعطيات الطبية الحديثة في هذه المسألة. ويتكون البحث من مقدمةٍ، ومبحثين، وخاتمة، يتناول المبحث الأول الكلام في معنى الجنين، ومراحل تكونه بإيجاز، ثم حكم الإسقاط بشكلٍ عام، وأما المبحث الثاني فقد تناول مسألة إسقاط الجنين الذي يهدد حياة أمه، وعرض أقوال الفقهاء فيها، وما أفاده الطب في ذلك، ثم الوصول إلى القول الراجح في المسألة.

Among the provisions that derive from the objects of preserving both the self and the children are the provisions that relate to the fetus. The most important provisions of these is the issue of abortion. Islamic scholars and jurists, classic and contemporary, have expanded in explaining this issue. However, the scientific developments in the field of medicine have opened new horizons and presented facts that were unknown to the classic jurists. Among these facts is the opinion on aborting the fetus if the continuation of the pregnancy threatens the life of the mother. This research attempts to explore this issue and the deliverance of the formal Islamic jurisprudent opinion by extrapolating the opinions of classic and contemporary jurists. The study, furthermore, takes advantage of the advanced modern medical data on this issue.
The research consists of an introduction, two chapters, and a conclusion. The first chapter addresses the meaning of and defines the fetus, the stages of its formation briefly, then the opinion on abortion in general. The second chapter proceeds to tackle the issue of the fetus abortion which threatens the life of its mother. The opinions of the jurists as well as the medical field are thus presented. Finally, the preponderant opinion in the issue is presented.
