یشهد المجتمع الدولی الیوم ظاهرة جدیدة تتمثل بالنزوح، وهی ترک السکان لأماکنهم ومغادرتها لأسباب متعددة، وتعد هذه الحالة حدیثة قیاسا إلى حالات أخرى کاللجوء والهجرة، وما یمیز النزوح عن غیره هو عدم خروج الفرد من حدود دولته والبقاء فیها ضمن مناطق أخرى أکثر أمنا له ولأسرته، وعلى الرغم أن النازحین لیسوا موضوعا لاتفاقیة دولیة کاللاجئین، إلا إنهم یخضعون، لقانون حقوق الإنسان وقت السلم والقانون الدولی الإنسانی فی حالة النزاع المسلح.
إن الوضع الذی یعیشه النازح الیوم ولعدة أسباب یحتاج عقد اتفاقیة دولیة لرعایتهم بشکل أفضل وتحمل المسؤولیة فی حمایتهم والحفاظ على حقوقهم ومعالجة أسباب نزوحهم تمهیدا لعودتهم إلى مناطقهم.

Today the international community is witnessing new phenomenon of displacement : leaving the population to their place and leaving it for a variety of reasons. this situation is a new in comparison to other cases such as asylum and migration. the main characteristic of placement is the absence of the individual leaving his country and staying in other safe places for him and his family .this requires international intervention through the establishment of international legal norms on displacement. as well as. on national legislation that can contribute at finding solutions to it. the research sheds light on the legal organization to protect the right of displaced persons by stating the role of international human rights law and the protection required under international humanitarian law concerning international and domestic armed conflicts.
