ملخص
المقارنة بين الشريعة والقانون غدت واقعا حتميا في الدراسات الرامية إلى تحسين الأداء التشريعي للمؤسسات الوطنية والعربية، وبحكم ما مرت به من تطور وتشعب، يمكن أن تشكل نظرية متكاملة على مستوى المناهج والأهداف والموضوعات، فوجب الوقوف عندها لرصد مسارها العلمي وتحديد محطاته المهمة وتشخيص مشكلاته. هذه الورقة محاولة لإثارة الموضوع، والتنبيه على أهميته في ظل طغيان موجة العولمة ومشاريع الهيمنة الغربية... لا ندعي تقديم نظرية متكاملة للمقارنة بين الشريعة والقانون، بقدر ما نهدف إلى إثارة التساؤل حول إمكانية بلورة مثل هذه النظرية، فاقتصرنا على طرح مشكلات البحث المقارن وجوانب من واقعه، لتوجيه الاهتمام نحو تأسيس الأطر اللازمة لاستكمال أركانها.

Abstract
The comparison between Sharia and the law has become a reality imposed in studies aimed at improving the legislative performance of national and Arab institutes. they can form an integrated theory in this field; it has developed in methods, objectives and all fields. We must take care of its achievements, to monitor its scientific track, and diagnose its problems. This paper is an attempt to raise interest in this subject, which is very important in the shadow of the tyranny of globalization and Western civilization, We don't claim to provide an integrated theory of comparison between Sharia and law, but we raise the question about the possibility of developing such a theory, we just displayed the problems of comparative research and aspects of its reality, To draw attention towards establishment frameworks to complete its pillars.
