اتفق على أن الحقوق تتنوع بين حقوق سياسية و أخرى مدنية ، تتفرع عنها حقوق عائلية، وحقوق مالية، وهذه الأخيرة تتوزع بين كل من الحقوق العينية الأصلية، والحقوق العينية التبعية، والحقوق الشخصية والحقوق الأدبية ، حيث أن هذا التقسيم لم يستوعب كافة الحقوق وهذا بظهور حقوق غير مادية تسمى بالحقوق المعنوية نظمت بموجب نصوص خاصة باعتبارها ترد على أشياء غير مادية . والحقوق المعنوية هي سلطات يخولها القانون لشخص ما على إنتاجه الفكري أو الأدبي أو الفني أو الذهني حيث يكون له حق احتكار المنفعة المالية الناتجة عن استغلالها وما يميزها أن محلها أشياء غير مادية وغير ملموسة ، وإنما يمكن تصورها فقط لذلك تدرج ضمن المنقولات المعنوية ، وهي تتميز بطبيعة مزدوجة خاصة لأ نها تقوم على جانبين أحدهما معنوي و الآخر مالي .
