لا ريب أن القضاء الدستوري من أبرز المؤسسات المعنية بالتأويل الديمقراطي للدستور؛ لأن التأويل يمثل الوسيلة الأساس التي تضمن استقرار الدساتير وثباتها؛ ولأنه السبيل الوحيد الذي يمكِّن من استيعاب النصوص المحدودة للوقائع غير المتناهية. ومن تم، يستمد البحث في تأويل الدستور من خلال ممارسات القضاء الدستوري مشروعيته وراهنيته؛ وهذه الدراسة، بعد أن حددت مفهوم التأويل في اللغة والاصطلاح، وتحدثت عن الإطار الدستوري الذي يحدد ضوابط التأويل وشروطه وضمانات التأويل العادل، المتمثلة في الاستقلالية والحيادية، والكفاءة والتجربة والنزاهة، والمصداقية والتوازن، عمدت إلى عرض ممارسة أنموذجية للتأويل الديمقراطي للدستور كما جسدها المجلس الدستوري المغربي، وتقديم سبعة أمثلة تطبيقية لهذه الممارسة، تمثل أبرز اجتهادات هذا المجلس في ضوء دستور 29 يوليو 2011، وهي في عمومها، تظهر أن التأويل الذي مارسه المجلس المذكور، فضلا عن كونه واجب التطبيق لتحقيق العدالة في أجلى صورها، فإنه يمارسه ويطبقه على الوقائع المعروضة عليه، ليس فقط كمنهج لفهم نصوص الدستور فهما سليما، وإنما أيضا كمنهج للنظر في مآلات تطبيقها والتبصر بنتائج هذا التطبيق من خلال تحليله للوقائع المختلفة وتبيين عناصرها وظروفها وملابساتها ومعرفة الفروق الدقيقة بينها، وهو في كل ذلك، يروم تحقيق المصلحة والعدل والإنصاف...

The constitutional judiciary is undoubtedly one of the institutions concerned with the democratic interpretation of the constitution; because the interpretation represents the basic means which guarantees the stability of the constitution and their constancy; and because it is the only means which makes us able to assimilate the limited texts of the unlimited facts. Hence, the research in the interpretation of the constitution gains its ligitimacy and renaissance from the constitutional judiciary practice; and this study after having defined the concept of interpretation in language and terminology, and it talked about the constitution framework which determines the regulations of the interpretation and the guarantees of the fair interpretation is represented in independence, neutrality, efficiency, experience, integrity, credibility and balance, proceeded to presenting a typical practice of the democratic interpretation of the constitution as it was shown by the Moroccan constitutional council and the presentation of the seven applicated examples of this practice, it represents the most important reasoning of this council in the light of the constitution of July 29th 2011, and in general it reflects that the interpretation practised by the council in question, as well as being a duty to achieve justice in its clearest appearance, thus it practises and applies to the presented facts, not only as a method to understand the constitution texts correctly, but also as a method to look at its application and to investigate its results through analysing the different facts and identifying its components, conditions and circumstances and the knowledge of their exact differences, and in all of this, it aims to achieve interest, justice and equity ....
