تنصب هذه الدراسة على تنازعُ الاختصاصِ بينَ القضاءِ العسكريِّ والقضاءِ المدني حيث تطرقت لإظهار اوجه التنازع بين القضاء العسكري والقضاء المدني سواء كان تنازعا ايجابيا او سلبيا.
أكد القانون الأساسي الفلسطيني المعدل لعام 2003 على انشاء المحاكم العسكرية بقوانين خاصة وبأنه ليس لهذه المحاكم أي اختصاص أو ولاية خارج نطاق الشأن العسكري، والواقع ان القانون الاساسي لم يحسم اختصاصات القضاء العسكري بشكل واضح، وعليه كان لا بد من تحديد المرجع المختص بنظر التنازع بين القضاء العسكري والقضاء المدني سواء في فلسطين او في القوانين المقارنة.
حاولت الدراسة الوقوف على اختلافات التشريعات المنظمة للقضاء العسكري في العديد من الدول، ومقارنتها بالتشريعات الوطنية في فلسطين.

This study focuses on the conflict of jurisdiction between the military judiciary and the civil judiciary, also this study mentioned the conflict between the military and the civil judiciary if it was in a positive or a negative way, and the Palestinian law conform on establishing the military courts on specific laws and there is no control or anything to do outside the military issues, In fact, the Basic Law did not clearly resolve the jurisdiction of the military judiciary and so it should be staffed a competent reference in issues between the military and civil courts even if it was in the Palestinian laws or the comparative laws.
The study attempted to identify the differences in legislation regulating the military judiciary in many countries, and to compare it with the national legislation in Palestine
