استهدفت الدراسة لبحث سلطات القاضي الدستوري الفلسطيني من خلال التحليل المقارن السلطات الأصلية لا سيما الرقابة على دستورية القوانين واللوائح التنفيذية، وتفسير نصوص القانون الأساسي والتشريعات العادية والفصل في تنازع الاختصاص ين الجهات القضائية وبين الجهات الإدارية ذات الاختصاص القضائي.
كما تعرض الباحثان في البحث للسلطات التبعية التي تقوم للقاضي الدستوري بناءً على إختصاصاته الأصلية والمتمثلة بسلطة التحقق من شرط المصلحة، شرط الصفة، شرط الأهلية، والسلطة التبعية بالتصدي للنص غير الدستوري أثناء نظره للدعوى.
حاولت الدراسة الوقوف على سلطة القاضي الدستوري التقديرية عند مباشرته في تطبيق بعض النصوص الدستورية والتشريعية المرنة المستندة الى اختصاصاته الواردة في نصوص القانون الأساسي والتشريعات العادية، وكذلك التعرض لموقف فقه القضاء الفقه بشأنها، للبحث في مدى التوسع في سلطات القاضي الدستوري.

The study aimed at examining the role and authorities provided to the judges of the constitutional courts in Palestine. It argues that the constitutional judge has a restricted power, which in turn, may open the possibility to impair the independence of the individual judge, making the court’s decision is not free from political influence. Both analytical and comparative methods have been used in this study to support the argument. the legislative oversight and analysis of legislations, including the Palestinian Basic Law will be examined in this research.
Furthermore, the study discusses the constitutional judge's subordinate powers represented in the authority, to verify the condition of interest, the condition of capacity, the condition of eligibility, and the subordinate power to address the unconstitutional text during his consideration of the case.
The aim of the study is to determine the constitutional judge's discretionary authority when applying some flexible constitutional and legislative texts. Moreover, the constitutional scholars’ opinions, as well as, the Judaical perspectives on the subject of the role of constitutional court will also be examined in this study.
