تناول هذه الورقة البحثية الحماية القانونية للحق البيئي، قاصدا بذاك ترجمة مبدأ حق الإنسان في بيئة ملائمة ونظيفة، الذي أقرته المؤتمرات والاتفاقيات الدولية في العديد من أدوار انعقادها إلى شيء ملموس في الواقع القانوني والقضائي، ويتسنى للمواطن بموجبه الدفاع عن البيئة أمام القضاء انطلاقا من حقه في العيش في البيئة الملائمة والنظيفة. انطلاقا من أن الاعتداء على البيئة بالتلويث والإفساد لا تكون آثاره محدودة، كالاعتداء على الأشخاص أو الأموال مثلا، وإنما يكون عدد غير محدود من البشر عرضة للآثار والتداعيات السلبية لهذا التلوث والإفساد، نتيجة انتقال الملوثات عبر وسائط الماء والهواء، مما يعطى لهؤلاء الحق في رفع الدعوى دفاعا عن البيئة انطلاقا من حقهم في العيش في بيئة ملائمة وسليمة.

This research paper dealt with the legal protection of the environmental right, with the intention of translating the principle of the human right to an adequate and clean environment, which was approved by international conferences and conventions in many of their sessions, into something tangible in the legal and judicial reality, whereby the citizen can defend the environment before the judiciary based on his right to Living in an appropriate and clean environment. Proceeding from the fact that the attack on the environment by pollution and corruption does not have limited effects, such as assaulting people or money for example, but an unlimited number of people are subject to the negative effects and repercussions of this pollution and corruption, as a result of the transmission of pollutants through the mediums of water and air, which gives them the right to file a lawsuit In defense of the environment based on their right to live in an appropriate and sound environment.
