تهدف هذه الورقة إلى تسليط الضوء على ظاهرة التمييز وخطاب الكراهية المتنامية في المجتمع الجزائري عبر وسائط التواصل الاجتماعي أساسا. وتأخذ هذه المسألة، في الواقع، بعدا خاصا في مجتمع متعدد ويعيش أزمة هوية. ما يجعلنا نبحث في أجوبة عن التساؤلات التي تفرضها الأنترنيت كوسيلة رائعة للاتصال والاعلام، ولكن أيضا كوسيط ناقل للإحباط والكراهية والأكاذيب.
تبعا لذلك، لم تتوان الدولة الجزائرية للتصدي لخطاب الكراهية الذي يشكل تهديدا لقيم الديمقراطية، والاستقرار الاجتماعي والسلم، بإصدار القانون 20-05 حول الوقاية ومكافحة التمييز وخطاب الكراهية الذي يقر بإنشاء مرصد وطني لوضع حد لهذه الظاهرة، إلى جانب تعديل واستكمال الأمر 66-156 يتعلق بقانون العقوبات 20-06.
ويخلص البحث إلى أن مواجهة خطاب الكراهية لا يعني التضييق أو منع حرية التعبير، لكن تجنب أن يأخذ الخطاب أبعادا خطيرة، خصوصا من خلال التحريض على التمييز، والعدوانية والعنف. وهذا ما ينبغي أن يقف عليه المرصد الوطني مستقبلا فور تنصيبه.

his paper aims to highlight the phenomenon of discrimination and hate speech in Algerian society, mainly through social networks. Really, in a society that is increasingly diverse, but which is also a society in crisis, this question takes on particular urgency. We should also think of the many questions posed by the Internet, an extraordinary communication and information tool, but also a vector of frustration, hatred and lies.
The Algerian State quickly reacted to hate speech which constitutes a threat to democratic values, social stability and peace, by adopting Law 20-05 on the prevention and fight against discrimination and hate speech which provides the creation of a national observatory to overcome this phenomenon, while modifying and supplementing the ordinance n° 66-156 of June 8, 1966 establishing the penal code via law 20-06.
The research concluded that dealing with hate speech is not about limiting or prohibiting freedom of expression, but about preventing it from escalating to more dangerous proportions, including in the form of incitement discrimination, hostility and violence, which the national observatory must ensure in the future.
