تفرض التطورات الجوهرية في اطار فروع القانون الدولي المعاصر، والاتساع الكبير في مجال التعامل مع القضايا ذات الاهتمام العالمي المشترك، قيام اشخاص القانون الدولي والفاعلين من غير الدول بالعمل معا من اجل تحقيق مقاصد التنظيم الدولي في حفظ الامن والسلم الدوليين وتطوير المجالات الخاصة بخدمة الحياة الإنسانية في اطار ينسجم مع التغير في الأدوار الجوهرية التي كانت تناط لكل من الدول والمنظمات الدولية الحكومية، واهمية الاعتراف بان هناك نمو حقيقي لفكرة المواطنة العالمية وان هناك من الالتزامات القانونية الدولية ما يصعب تحقيقها الا من خلال التعامل مع هذه الفكرة ونتائجها واثارها والتي تعبر عن تطور كبير في المركز القانوني الدولي للفرد وقدرته على ان يكون جزء من الاطراف المكلفين بنفاذ قواعد القانون الدولي بطرق معينة وبحدود تتناسب مع المكانة التي يتمتع بها في الواقع الدولي القائم، في ذات الوقت هناك الكثير من المشكلات المتعلقة بمصطلح المواطنة العالمية ومضمونه وعناصره وتطوره التاريخي ومدى رسوخه في التنظيم الدولي وحدود نجاحه في التعبير عن حالة من التضامن العالمي تجاه القضايا العالمية ذات الاهتمام الأبرز من قبل المنظمات الدولية العالمية كالأمم المتحدة ووكالاتها المتخصصة والمنظمات الإقليمية كالاتحاد الأوربي، وثمة إشكاليات أخرى ترتبط بمفاهيم السيادة الوطنية والجنسية والهوية الثقافية الوطنية والخضوع للقانون الداخلي، وعدد اخر من التحديات التي لاتزال تطرح من قبل الفقه الدولي في مجال التعامل مع هذا الموضوع للوصول الى انضاج تجربة واضحة فيما يخص الإقرار بوجوده وطبيعته واثاره القانونية.

Abstract:
The fundamental developments within the framework of the branches of contemporary international law, and the great expansion in the field of dealing with issues of common global concern, require the persons of international law and non-state actors to work together in order to achieve the purposes of the international organization in maintaining international peace and security and developing areas related to serving human life in A framework in line with the change in the fundamental roles that were assigned to each of the states and intergovernmental organizations, And the importance of recognizing that there is a real growth of the idea of global citizenship and that there are international legal obligations that are difficult to achieve except by dealing with this idea and its results and effects, which express a great development in the international legal status of the individual and his ability to be part of the parties charged with enforcing the rules of international law in various ways certain and within limits commensurate with the position it enjoys in the existing international reality, At the same time, there are many problems related to the term global citizenship, its content and elements, its historical development, the extent of its consolidation in the international organization, and the limits of its success in expressing a state of global solidarity towards global issues of most prominent concern by global international organizations such as the United Nations and its specialized agencies and regional organizations such as the European Union. Other problems related to the concepts of national sovereignty, nationality, national cultural identity, submission to internal law, and a number of other challenges that are still posed by international jurisprudence in dealing with this issue to reach the maturity of a clear experience regarding the recognition of its existence, nature and legal effects.
