كشفت التطورات المعاصرة في نظم القانون الدولي بروز الكثير من الاتجاهات الرامية إلى إيلاء المزيد من الاهتمام للقضايا الجوهرية المرتبط بالفروع التي تعالج قضايا حقوق الإنسان في هذا القانون، فكانت حصة القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني في هذا الاهتمام هي الأكبر والأكثر من بين باقي فروع القانون الدولي، وأخذت الكثير من الدراسات تسلط جل اهتمامها على الأبعاد الإنسانية للقاعدة القانونية الدولية، وعلى سُبل إنفاذ قواعد الحماية أثناء الظروف الاستثنائية، وكان في وسط هذه الأبحاث محاولات لإرساء نظرية جديدة حول تطور الجهود الدولية الحكومية وغير الحكومية في مجال التعامل مع فكرة الدبلوماسية الإنسانية، وبدأت هذه الفكرة تطرح بشكل اكثر جراءة ووضوح بعد أن برزت العديد من المعطيات والأسباب المقنعة التي تبرر الالتزام بهذه الفكرة والاعتماد عليها كمنهج عمل دائم من اجل الوصول إلى تحقيق المنطلقات السلمية في تخطى الكوارث والأزمات، ومن ثم حاول البعض أن يصيغ إطاراً فلسفياً وفكرياً وقانونياً يستوعب تحديد المفاهيم الجوهرية للدبلوماسية الإنسانية ويتعامل مع عناصرها ومكوناتها وأهدافها ومظاهرها ويتتبع اليات تحقيقها في الميدان، ومن هنا جاء هذا البحث هذه من اجل إعادة تشكيل المفاهيم الأساسية المتصلة بالدبلوماسية الإنسانية والكشف عن المستقبل الذي ينتظر المجهودات الرامية للتأسيس لنظرية مستقلة تتعامل مع هذا المصطلح وتبرز ذاتيته وتكشف عن سمات هذا الاطار من العمل الإنساني المتضمن نشاط تفاوضي دبلوماسي لتحقيق أهداف إنسانية نبيلة.

Contemporary developments in international law systems have resulted in the emergence of many trends aimed at giving more attention to the substantive issues associated with the branches that deal with human rights issues in this law. The share of international human rights law and international humanitarian law in this interest is the largest and most among the rest of the branches international law, and many studies focused their attention on the human dimensions of the international legal rule, and on ways to enforce the rules of protection during exceptional circumstances. In the midst of these researches were attempts to establish a new theory about the development of international governmental and non-governmental efforts in the field of dealing with the idea of humanitarian diplomacy. This idea began to be presented more boldly and clearly after many convincing facts and reasons emerged that justify commitment to this idea and relying on it as a permanent work method in order to reach the achievement of peaceful premises in overcoming disasters and crises. Hence our study came in order to reshape the basic concepts related to humanitarian diplomacy and to reveal the future that awaits efforts to establish an independent theory that deals with this term and highlights its subjectivity and reveals the features of this framework of humanitarian action that includes diplomatic negotiating activity to achieve noble humanitarian goals.
