تناول البحث حد الإحصان ومدى اعتبار استدامة الزواج فيه «دراسة فقهية مقارنة في ضوء مقاصد الشريعة»، حيث مهَّد له ببيان مقاصد العقوبات في الشريعة الإسلامية بوجه عام، وعقوبة الرجم بوجه خاص، وأنها زواجر تحفظ نظام الأمة وتحمل الناس على الفضيلة والخير وتأخذ للمعتدى عليه حقه، وتحقق مقصد حفظ النسل. وبين مستقرِئًا ومحلِّلا في المبحث الأول منه حد الإحصان في آراء الفقهاء، فعرض له في المذاهب الفقهية الثمانية السنية وغيرها، ووازن بينها وانتهى إلى أنه متى توفر للرجل أو للمرأة العقل والبلوغ والزواج الصحيح وحصول الوطء المكتمل فيه تحقق لهما الإحصان. وخصص المبحث الثاني لبيان مدى اعتبار استدامة الزواج في حد الإحصان، ورجح البحث بالتحليل والاستنباط أنها معتبرة؛ فمن ماتت زوجته أو فارقها ليس بمحصَن، ومن مات زوجها أو فارقها ليست بمحصَنة، وعقوبة كلٍّ منهما إذا زنيا بشروطها الجلد والتغريب- على التفصيل في ذلك- لا الرجم.
الملخص الانجليزي
This is a study: The Limit of The Fortification and the extent to which the sustainability of marriage is considered "a comparative jurisprudential study in the light of the objectives of the Sharia". I presented to it a statement of the purposes of punishments in Islamic law in general, and the punishment of stoning in particular, and made it clear that it preserves the order of the nation and holds people to virtue and goodness, takes the right of the victim, and fulfills the purpose of preserving the honor, In the first section I showed the limit of the fortification in the opinions of the jurists, so I introduced it to the Sunni schools of jurisprudence and others, and I compared between them and concluded that if a man or a woman had the mind, puberty, correct marriage and the occurrence of complete intercourse in it, they achieved the fortification. I devoted the second section to explaining the extent to which the sustainability of marriage is considered a fortification. If his wife dies or divorces his wife is not immune, and whoever dies or divorces her husband is not immune, and the punishment for each of them if he committed adultery and the conditions of the punishment are fulfilled in them are flogging and exile - in detail in that - not stoning.
