يتناول البحث قضية حقوق الإنسان التي تلتقي مع أهداف التنمية المستدامة، باعتبار أن غياب تلك الحقوق أحد أهم معوِّقات التنمية. وبما أن الفتوى لها دور محوري في حياة المجتمعات؛ فإن البحث يستهدف تسليط الضوء على دور الفتوى في إرساء حقوق الإنسان، من خلال فتاوى دار الإفتاء المصرية، التي تمثل الفتوى المؤسسية المنضبطة في المجتمع المصري. فعرض البحث لتعريف الفتوى وبيان أهمية الفتوى المؤسسية في قضايا الشأن العام، كما عرَّف حقوق الإنسان وبيَّن أهميتها وموقف الإسلام منها، ثم بيَّن دور الفتوى في دعم حقوق الإنسان من خلال فتاوى دار الإفتاء المصرية، مستخدمًا المنهج الوصفي، والمنهج الاستقرائي، والمنهج التحليلي. وانتهى إلى جملة من النتائج أهمها: أن الشريعة الإسلامية أعطت لكل ذي حقٍّ حقه، وكرَّمت الإنسان، وشرعت الأحكام لتحقيق مصالح الناس في الدنيا والآخرة، وأن حقوق الإنسان في الإسلام واجبات دينية وضروريات شرعية، وأن الإسلام أقرَّ حق الإنسان في الحياة، وحرم قتل النفس، وجعل حفظ الدين والنفس والعقل والعرض والنسل والمال ضروريات تدور حولها أحكام الشريعة، وصان كرامة الإنسان وشَرَفَه وسُمعَتَه، وأقرَّ حريته في معتقده ورأيه وتفكيره، وجعل له كيانًا مستقلًّا وشخصيةً قانونيةً، وأناط به مسئولياته، وقرَّر مبدأ العدالة، وأرسى مبدأ المساواة، وأباح له الضَّربَ في الأرض والتكسب والعمل، والتنقل والإقامة حيث شاء، كما صان له مسكنه وخصوصيته، وأقرَّ حقه في التملُّك، وصان ملكيته عن اعتداء الغير، وأكَّد حقه في التعليم وحثَّ عليه وأمر به، وأقرَّ حقه في الزواج وتكوين الأسرة، وجعل للرحم حقًّا، وجعل التكافل الاجتماعي مبدأً من مبادئ المجتمع، فشرع النفقات والميراث والوصايا، والزكاة والصدقات، وحث على تفريج الكربات، وكفالة الأيتام والأرامل والمطلقات ممن لا عائل لهم، وعلاج المرضى، والتعاون في الخير والبر، وأقرَّ حقه في المشاركة في الشأن العام وأمور الحكم، وأن للفتوى دورًا مهمًّا في دعم حقوق الإنسان، وأن دار الإفتاء المصرية قامت بهذا الدور خير قيام، وصدر عنها مئات الفتاوى التي تدعم حقوق الإنسان في جميع المجالات.

The research deals with the issue of human rights that converge with the goals of sustainable development, given that the absence of these rights is one of the most important obstacles to development. Since the fatwa has a pivotal role in the life of societies; The research aims to shed light on the role of the fatwa in establishing human rights, through the fatwas of Egypt’s Dar Al-Ifta, which represents the disciplined institutional fatwa in Egyptian society. The research presented the definition of the fatwa and the importance of the institutional fatwa in issues of public affairs, as well as defining human rights and explaining their importance and the position of Islam on them. Then it showed the role of the fatwa in supporting human rights through the fatwas of Egypt’s Dar Al-Ifta, using the descriptive method, the inductive method, and the analytical method. It concluded with a set of results, the most important of which are: that the Islamic Sharia has given everyone his right, honored man, and legislated rulings to achieve the interests of people in this world and the hereafter, and that human rights in Islam are religious duties and legal necessities, and that Islam acknowledges the human right to life, and forbids killing oneself. He made the preservation of religion, soul, reason, honor, offspring and money necessities around which the provisions of Sharia revolve, and he safeguarded human dignity, honor and reputation, established his freedom in his belief, opinion and thought, and made him an independent entity and legal personality, and assigned him his responsibilities, decided the principle of justice, established the principle of equality, and permitted him to strive for Land, work, movement and residence wherever he wants, and It made social solidarity a principle of society, so he legislated expenditures, inheritance, bequests, zakat and alms, urged relief from distress, sponsoring orphans, widows and divorced women who have no breadwinner, treating sick people, cooperating in goodness and charity, and affirmed his right to participate in public affairs and matters of governance, and that the fatwa An important role in supporting human rights, and that Egypt’s Dar Al-Ifta played this role well, and issued hundreds of fatwas that support human rights in all fields.
