إن من ابرز الاكتشافات العلمية التي حدثت في السنوات الأخيرة هي البصمة الوراثية(D.N.A) التي تسهم في تحديد النسب وحالات التنازع على مجهول النسب بمختلف صور التنازع التي ذكرها الفقهاء عموما سواء أكان التنازع على مجهول النسب بسبب انتفاء الأدلة أو تساويها أم كان بسبب الاشتراك في وطء الشبهة ونحوه من الحالات التي يدعي فيها رجلان نسب الولد المجهول النسب أو اللقيط , وحالات الاشتباه في المواليد بالمستشفيات وبمراكز رعاية أطفال الأنابيب وحالات ضياع الأطفال واختلاطهم بسبب الحوادث والكوارث وحالات عدم التعرف على الهوية وغيرها.
فالنسب يعد رابطة سامية وصلة عظيمة على جانب كبير من الخطورة والأهمية , لأنها رابطة شرعية بين شخصين يثبت لكليهما بمقتضاها مجموعة من الحقوق ويجب عليه مجموعة من الالتزامات وتبنى عليها الأحكام الشرعية , لذلك فان الشارع الحكيم لم يدعها نهبا للعواطف والأهواء , بحيث يستطيع الإنسان أن يتصرف بها كيفما يشاء, وإنما نظم هذه الروابط بأحكام وقواعد خاصة ومن هذه القواعد تلك التي تتعلق بكيفية إثبات هذه الرابطة فقد حددت الشريعة الإسلامية والقوانين الوضعية طرقا معينة يتم بها هذا الإثبات .
ونظرا لهذه النتائج الخطيرة التي تترتب على هذه الرابطة، عني الشارع الحكيم بتنظيم أحكامه وحمايته من الأهواء والعبث، وأحاطه بسياج من التعاليم التي تؤكد قدسيته ، فقد احتاط لإثباته بأدنى الأسباب وجعله لا ينتفي إلا بأقوى الأدلة وبأقوى وسيلة لنفي النسب ألا وهو اللعان,لان في ضياع الأنساب مفاسد أخلاقية خطيرة تؤدي إلى تفكك الأسر وانهيار الأخلاق والفوضى وتهدم المجتمع فأهميتها في مجال النسب تنبع من أن حفظ الأنساب يعد من مقاصد الشريعة الإسلامية ويندرج تحت الضروريات والأصوليات الأساسية الخمسة,التي تسعى الشريعة الإسلامية والشرائع السابقة للحفاظ عليها, كما أن من غايات النكاح الأساسية هو إنشاء الرابطة للحياة المشتركة والنسل, هذا ما ستتناوله هذه الدراسة تحت عنوان الحجية الشرعية والقانونية للبصمة الوراثية في نفي النسب دراسة مقارنة .
