يتناول البحث قاعدة تقييد المباح التي اعتمدها فقهاء وعلماء مالكية المغرب الأقصى في التأصيل لاجتهاداتهم والتعليل لاختياراتهم وآرائهم الفقهية في قضايا الأسرة المعاصرة؛ كما يهدف البحث إلى بيان أثر فقه تقييد المباح في استقرار الأسرة وحفظ تماسكها، مع الإشارة إلى بعض تطبيقاتها في مدونة الأسرة المغربية. وقد حاول البحث الإجابة على عدة أسئلة، أهمها: ما الدور الوظيفي لقاعدة تقييد المباح في توسيع الاجتهادات الفقهية في قضايا الأسرة المعاصرة؟ وأثرها في دعم استقرار الأسرة والمجتمع؟ وقد جمع البحث بين الجانب النظري والجانب التطبيقي، حيث تم استحضار نماذج تطبيقية من المباحات في قضايا الأحكام الأسرية التي تم تقييدها إما بالمنع أو بالتضييق من مدونة الأسرة المغربية، مستخدما في ذلك المنهج الاستقرائي من أجل استقصاء النماذج الاجتهادية التطبيقية في مدونة الأسرة المغربية، بالإضافة إلى المنهجين الوصفي والمقارن من أجل المقارنة بين الفقه الإسلامي ومدونة الأسرة المغربية، وبعض القوانين الأسرية العربية. وخلص البحث إلى حقيقة وهي سعة فلسفة الشريعة الإسلامية وقواعدها ومقاصدها لمستجدات الأسرة المعاصرة، ودور قاعدة تقييد المباح في استقرار الأسرة؛ إضافة إلى ضرورة استيعاب هاته القاعدة استيعابا مصلحيا ومقاصديا من أجل حسن تنزيلها على واقعنا المعاصر المليء بقضايا الأسرة المستجدة والطارئة، والتي في حاجة إلى اجتهاد مقاصدي مصلحي.

The research deals with the rule of restricting the permissibility adopted by the jurists and scholars of the Malikis of Al-Maghrib Al-Aqsa in rooting their jurisprudence and justifying their jurisprudential choices and opinions in contemporary family issues. The research also aims to demonstrate the impact of the jurisprudence of restricting permissible in family stability and preservation of its cohesion, with reference to some of its applications in the Moroccan Family Code. The research attempted to answer several questions, the most important of which are: What is the functional role of the rule of restricting permissible in expanding jurisprudence in contemporary family issues? And its impact on supporting the stability of the family and society? The research combined the theoretical side with the applied side, as applied models of the permissibility were invoked in cases of family provisions that were restricted either by prohibition or by restriction from the Moroccan Family Code, using the inductive approach in order to investigate the applied jurisprudential models in the Moroccan Family Code, in addition to The descriptive and comparative approaches in order to compare Islamic jurisprudence, the Moroccan Family Code, and some Arab family laws. The research concluded with the fact that the philosophy, rules and purposes of Islamic law are broad to the developments of the contemporary family, and the role of the rule of restricting permissible in the stability of the family; In addition to the need to comprehend this rule in terms of interests and objectives in order to apply it properly to our contemporary reality, which is full of emerging and urgent family issues, which need diligence and interests.
