لاشك أن هذا القرن قد حفل بتطور تكنولوجي هائل في العلوم الأساسية الذي انعكس بدوره على المجالات التطبيقية , ومن بين ما أفرزته العلوم البيولوجية علم الهندسة الوراثية التي أصبحت حديث الساعة وتطالعنا الأنباء بتقدم كبير يوما بعد يوم بل ساعة بعد ساعة حتى سمي هذا العصر بالعصر الجينومي , لأن اكتشاف الإنسان لأحرف الجينوم سيمكنه من معرفة اللغة الجينومية وسيؤدي إلى اكتشاف القنبلة الجينومية وسيترك بصمات واضحة على مستقبل الإنسانية وهي تعد الخطوة الأولى في الطريق الذي سيمكن الإنسان من التحكم في جيناته.
فقد تعرف الإنسان على البحار واكتشف المحيطات ووصل الفضاء وكان يرسم الخرائط الدقيقة لكل اكتشافاته إلا أنه وفي هذه المرة يحاول أن يرسم خريطة نفسه فأكتشف العلماء أن الإنسان يرث من أبويه صفات يشترك معه فيها إخوته وأخواته, إلا أن كل إنسان ينفرد بنمط خاص في ترتيب جيناته ضمن كل خلية من خلايا جسمه فلا يشاركه فيها أي إنسان أخر في العالم .
فاستخدام الحمض النووي كدليل علمي في الإثبات يثير بعض الصعوبات والمشاكل وهي بالطبع تثير تحديات , خصوصا بعد أن أصبح الاتجاه السائد في التشريعات الوضعية يميل إلى الأخذ بالأدلة العلمية وعلى رأسها البصمة الوراثية في مجال إثبات النسب ونفيه , بل وقامت مجموعة من هذه التشريعات فعلا بتنظيم التقاضي بالبصمة الوراثية وأقرتها بنصوص خاصة, وأضحت هذه الوسيلة من وسائل الإثبات العلمية تشكل خطرا على حقوق الإنسان خاصة الحق في حرمة الجسد وهي السلامة الجسدية والحق في احترام الحياة الخاصة وتصطدم مع بعض المبادئ القضائية في الإثبات , هذا ما ستتناوله هذه الدراسة تحت عنوان تحديات الإثبات بالبصمة الوراثية في الإثبات القضائي المدني دراسة مقارنة .
