إن الحق في تقرير المصير يجسد احد الحقوق الدولية الجوهرية التي تكفل لكل الشعوب حق قانوني في أن يكون هو صاحب القرار الحقيقي في كل ما يتعلق بمستقبله وواقعه، وبالتالي يملك ذلك الشعب كامل التخويل القانوني في أن يقرر مصيره بحرية تامة ومطلقة ليحدد مسار حياته الاقتصادية والاجتماعية والثقافية وليكون سيدا على موارده الطبيعية وصاحب القرار في تحديد اليات التحكم بالموارد والثروات وصاحب القرار في اختيار النظام السياسي الذي يناسبه والذي يعبر عن إرادة ذلك الشعب، وهو حق طبيعي يستمده الشعب من منطلق فكرة الإرادة الشعبية الحرة التي هي انعكاس حقيقي لفكرة أن الشعب مصدر السلطات وهو الجهة المرجعية التي تستمد منها الإرادات الأخرى - المشتقة من إرادة الشعب- وجودها وشرعيتها وقدرتها على اتخاذ التصرفات والأفعال المناسبة التي تنسجم مع إرادة الشعب وتحقق رغباته ومتطلباته.
