فإنَّ الشريعة الإسلامية جاءت مبينة لجميع أمور الدنيا والدين، ومن أهم مقاصد هذه الشريعة، تحقيق الأمن, ولا سبيل لتحقيقه إلَّا بإقامة العقوبات والقصاص على الجاني وتطبيق شرع الله , ومن كمال هذه الشريعة أنَّها جعلت للإنسان حرمة عظيمة , فحرمت دمه وماله وعرضه , فلا يجوز الاعتداء على شيء من ذلك أبدا , وقد رتبت الشريعة على من اعتدى على ذلك عقوبات وأحكاماً معلومة.
إلَّا أنَّه هناك بعض الأمور تمنع القصاص أو تسقطه بعد وجوبه, ومن هذه المسقطات"إرث القصاص".حيث أنني سأتناول هذه المسألة في بحثي هذا وسأدرسها دراسة فقهية مقارنة.
