يجمع الفقه المالكي على أن الأصل في أغلب عقود المعاوضات المالية أن تنفذ بشكل فوري و منجز، منذ تاريخ استجماع أركان و شروط تكوينها، إلا أن بعض هذه العقود يتدخل الزمن في تنظيم علاقاتها المستقبلية، حيث يشكل الأجل وسيلة لتحديد التاريخ المستقبل، فيتم إرجاء آثار التصرف إلى الزمن المستقبل، و تأخير الوفاء بالالتزام إلى وجود الوقت المعين.
و يهدف هذا البحث إلى بيان أثر الأجل في عقد بيع السلم حسب ما جرى به العمل في الفقه المالكي، و الوقوف على أهم مسائل و إشكالات ضابط الأجل في هذه المعاملة المالية.
و قد زاوجت دراسة البحث بين المنهج الوصفي من خلال الوقوف على عدة نصوص فقهية في المذهب المالكي التي تنظم عقد بيع السلم، و المنهج التحليلي عند الوقوف على أهم الإشكالات التي عالجتها إجابات الفقه المالكي حول مقتضيات وضوابط و أثر الأجل في عقد بيع السلم.
و من بين أهم نتائج البحث، أن مسألة الزمن في عقد بيع السلم حسب الفقه المالكي لا يترتب عنها مقابل مالي، أي أن الزمن هنا من حيث القيمة غير مقيم بمقابل مال، و إنما يظهر أثر الأجل على العقد بعدم الصحة و بحصول الفساد، حيث لا يصح بيع السلم في الحال و كذا إذا لم يكن الزمن محددا، كما لا يصح أن يكون زمن التسليم مجهولا؛ فيفسد العقد هنا لجهالة الزمن أو لعدم تحديده.

This research aims to demonstrate the impact of the term on the contract for the sale of Salame in accordance with the work done in the Maliki jurisprudence and to identify the most important issues and problems of the term controller in this financial transaction. Research study has mixed the descriptive curriculum by identifying the various jurisprudence texts in the Maliki doctrine governing the Salame Sale contract and the analytical approach when identifying the most important problems addressed by the answers of the Maliki jurisprudence about the requirements, controls and impact of the term on the Salame Sale contract. One of the most important findings of the research is that the question of time in the Decade of Salame Sale, according to the Maliki jurisprudence, does not give rise to money. That is, time here in terms of value is not valued for money. but the impact of the term on the contract is manifest in invalidity and corruption, Salame Sale is not immediately valid, nor is it time-bound, nor can the time for extradition be unknown; The contract here is corrupted by the uncertainty of time or not defined.
