تكتسي الآجال -سواء تلك التي يمنحها القاضي حسب سلطته التقديرية أو التي هي حق عام لطرفي الدعوى- أهمية بالغة في مختلف مسارات التقاضي؛ فضبط آجال معينة في إطار الدعوى القضائية من شانه أن يحقق حماية مثلى لحقوق طرفي الدعوى، ويضبط مدة النزاعات كي لا تطول لزمن غير معلوم. ولعل أحد أهم أعطاب النظام القضائي هو الكم الهائل من الأحكام التي تصدر بعدم قبول الدعوى، والتي يرجع السبب في معظمها إلى إشكالية تدبير الزمن القضائي وضبط الآجال القضائية.
وقد بات معلوما أثر خوارزميات الذكاء الاصطناعي في تطوير منظومة القضاء، من خلال محاكاتها للذكاء البشري، بما يعزز من تحقيق العدالة الناجزة، وجودة الحكم القضائي، والإدارة المحكمة لمختلف إجراءات التقاضي.
تسعى هذه الدراسة إلى معالجة مشكلة بحثية تتمثل في بيان أثر تطبيقات الذكاء الاصطناعي في ضبط الأجل القضائي المفضي إلى إصدار حكم قضائي يرد الحق إلى صاحبه داخل آجال معقولة. وهل يمكن أن يحل الذكاء الاصطناعي محل القاضي البشري في منح وتقدير الأجل القضائي؟ كما أبرزت الدراسة التحديات والمخاطر والمحاذير بشأن توظيف خوارزميات الذكاء الاصطناعي في تدبير الزمن القضائي، واقترحت بعض الاستراتيجيات للاستثمار الأنجع للذكاء الاصطناعي في منظومة القضاء.
وسيخصص المبحث الأول من الدراسة لعرض الإطار المفاهيمي لمفردات البحث الجوهرية، بينما يتطرق المبحث الثاني إلى أثر توظيف خوارزميات الذكاء الاصطناعي في ضبط الأجل القضائي، والمخاطر والمحاذير والتحديات بشأن توظيف خوارزميات الذكاء الاصطناعي في تدبير الزمن القضائي. وتختتم الدراسة باقتراح بعض الاستراتيجيات للاستثمار الأنجع للذكاء الاصطناعي في منظومة القضاء.

The delineation of time frames - whether those bestowed by the judge through his discretionary authority or those stemming from the public rights of the litigants - assumes profound significance across diverse trajectories of litigation. Imposing specific temporal bounds within the framework of judicial proceedings has the capacity to confer optimal safeguards upon the rights of the disputing parties, concurrently orchestrating the duration of conflicts to preclude indefinite elongation. Perhaps one of the most conspicuous maladies afflicting the judicial system is the sheer multitude of verdicts rendered upon the inadmissibility of the suit. The crux of the issue in the majority of such cases can be traced back to the intricacies surrounding temporal administration within the judicial context and the regulation of legal timeframes.
The influence of artificial intelligence paradigms on the evolution of the judicial system has become a well-recognized phenomenon. By emulating human intelligence, these paradigms contribute to the attainment of a more refined justice, an elevated quality of judicial adjudication, and the adept administration of various litigation processes.
This study endeavors to address a research quandary that revolves around delineating the impact of artificial intelligence applications on regulating the judicial timeframe, culminating in the issuance of a judicial verdict within reasonable limits. Can artificial intelligence supplant the human judge in bestowing and determining the judicial timeline? Additionally, the study accentuates the challenges, risks, and cautionary considerations inherent in the integration of artificial intelligence algorithms in temporal management within the judicial context. It proffers certain strategies to optimally harness artificial intelligence within the judicial system.
