نظراً إلى دعاوى التجديد التي ظهرت في العصور المتأخرة، وحراكاتها المتواصلة في المطالبة بتجديد الخطاب الديني، فقد برزت طائفة من هذه الأمة تزعم أنها تريد إحياء الدين، وبث الروح فيه، من خلال إعادة قراءة النصوص الشرعية قراءة جديدة.
وتهدف هذه الدراسة إلى بيان ونقد موقف إحدى أكبر التيارات الفكرية المعاصرة من مقاصد الشريعة.
وقد خلُصت الدراسة في بيان ونقد موقف الحداثيين من تقديم المقاصد على النصوص والعلل الأصولية إلى: أن الفهم المقاصدي الذي تبناه الحداثيون لاستمداد الأحكام من خلاله، هو فهمٌ غير سليم إذ أوقعهم في انحرافات كثيرة من خلال تعاملهم مع النصوص الشرعية، كما أنه لا يلتفت إلى المقاصد الشرعية بمعزل عن النصوص، كما أن التوظيف الحداثي الخاطئ للمقاصد هو محاولة للتفلت من الأحكام الشرعية والتمرد على النصوص الجزئية بحجة أن هذه الأحكام خاصة لحقبة زمنية وظروف بيئية معينة.
