تعتبر البحوث المهتمة بتوضيح العلاقات بين الأصول والقواعد من المواضيع المهمة التي ينبغي أن تلتف حولها الجهود، وأن يُصرفَ إليها المزيد من الاهتمام والعناية لعظم الحاجة إليها في الكشف عن تكامل العلوم الشرعية. ولقد جاءت هذه الورقات البحثية تحاول أن تكشف عينة من هذا التكامل والتواصل، بحيث ستركز على كشف علاقة الأصول الاجتهادية المالكية بالقواعد الأصولية المتعلقة بفقه الموازنات، واختارت أنموذجا لذلك قاعدة ارتكاب أخف الضررين، فربطتها بأصل المصلحة المرسلة وأصل الاستحسان وأصل الذرائع وأصل مراعاة الخلاف.
الملخص الانجليزي
The Researches which are involved in elucidating the relationships between rules and principles are among the vital subjects around which efforts should bypass. And that the scientific seminars be granted much care due to its dire need for the detection of the interrelationship and complementarily of forensic sciences. This research has attempted to reveal a sample of this overlap, integration and communication. Its aim is to focus on revealing the relationship of the Fundamental rules related to the jurisprudence equiponderating and its relationship with some Studiousness aspects at Malikite Doctrine. The rule of committing the lesser two nuisances was taken as a model and it linked it with committing the lesser two nuisances and the principle of the preference and principle of pretexts and the principle of care towards controversy.
