الحق في النسيان الرقمي من الحقوق الشخصية التي أثارت جدلاً واسعاً في المحيط الافتراضي لاسيما بعد صدور حكم محكمة العدل الأوروبية رقم C-131/12 الصادر بتاريخ 13 مايو 2014، الذي أطلق العنان للمشرع الأوروبي للتأكيد عليه صراحة في المادة 17 من التوجيه الأوروبي رقم 679/2016 بشأن حماية البيانات الشخصية. فهذا الحق أصبح مُهدراً بسبب عدم قدرتنا كمتعاملين في البيئة الإلكترونية من السيطرة على بياناتنا الشخصية، التي قد تظهر لنا من جديد بعد مرور سنوات إما في محركات البحث أو اكتشافها في حيازة أشخاص قد لا تربطنا علاقة بهم. تعتبر فرنسا نموذجاً أوروبياً واجه هذه المشكلة بتجريم الاعتداء على الحق في الدخول في طي النسيان الرقمي في التشريع العقابي. سنبحث في هذه الدراسة المفهوم العام لهذا الحق والموضوع الذي ينصب عليه لتحديد المشكلة وتأصيلها على ضوء ما جاء من أحكام في التوجيه الأوروبي الجديد وأحكام التشريع الفرنسي، ثم ننتهي بتحديد نطاق تجريم الاعتداء على الحق في النسيان الرقمي.
Abstract
The fact that the right to digital oblivion is one of the personal rights associated with humans, and since this right has been washed in the electronic environment which led the European legislator, especially after the judgment of the European Court of Justice No. C-131/12 of 13 May 2014 to emphasize the right the digital oblivion In article 17 of the new European Directive No. 679/2016 on the protection of personal data, where France considers as a European model to criminalize the violation of this right in its penal legislation.
Accordingly, this research aims at clarifying the general concept of the right to digital oblivion and the ambit of the criminalization of the violation of this right based on the French legislator's way of protecting this right in the light of the resolution of the new European directive.
